Compliance - Overdraft Litigation
In light of the recent
NAFCU Compliance Blog on overdraft litigation, we think it is a good time to ask, "Are you doing what you say you are doing?" If not, you could have Regulation E violations as well as potential UDAP concerns. When was the last time you reviewed your account disclosures? It is not always regulatory changes, but also legal cases which can create the need for a disclosure review. Overdraft concerns have created a combination of the two.
Current legal cases have consumers alleging they did not have enough information to reasonably avoid overdrafts, or that an institution's overdraft disclosure did not disclose the overdraft policies or they were not adequately disclosed. Some of these allegations are resulting in allegations of UDAP violations. The UDAP rules leave some things open to interpretation which can make it more difficult to comply versus a rule that says you must do a, b, and c.

Compliance - Economic Growth, Regulatory Relief, and Consumer Protection Act
The Economic Growth, Regulatory Relief, and Consumer Protection Act goes into effect on September 21, 2018, requiring credit reporting agencies to provide free credit freezes, free child credit freezes, and year-long fraud alerts.
Starting this fall, it will be free to freeze and unfreeze your credit file throughout the country, free to freeze a child's credit file for children under age 16, and initial fraud alerts will last for one year with extended fraud alerts for seven years.
Equifax, Experian, and TransUnion will be required to set up a webpage for requesting fraud alerts and credit freezes. Also, within a year, credit reporting agencies must offer free electronic credit monitoring to all active duty military.
