K–12 Disability Case Holds Title IX Implications

Tip of the Week developed by Cynthia Gomez, Director of Publications & Content Development, The NCHERM Group, LLC

 

A resolution agreement between the Office for Civil Rights and the Fort Zumwalt R-II School District in Missouri meant to address allegations of disability discrimination holds some important, gender-equity implications for colleges and universities.

 

The complainant is the parent of a student with a disability. The parent claimed the district discriminated against the student by: 1) failing to evaluate her and provide her with regular or special education and related aids and services in a timely manner; and 2) providing significant assistance to a third-party program housed at the school that expelled the student on the basis of her disability.

Resource Spotlight

 

On Thursday, September 17th, the White House Task Force announced the release of notable resources to support the efforts of students, faculty, administrators, and communities around the country to prevent and improve the response to sexual violence at colleges and universities.

 

A Resource Guide to Prevent and Improve the Response to Sexual Violence at Colleges and Universities comes directly from the White House Task Force and is intended to be informative and flexible, addressing the unique circumstances and needs of distinct campus communities.

 

Safe Place: Trauma-Sensitive Practice for Health Centers Serving Students toolkit was developed by the Department of Education's National Center on Safe Supportive Learning Environments and encompasses a broad range of material introducing and endorsing trauma-sensitive practice with an emphasis on sexual assault trauma. Designed specifically for health center staff who serve as primary care providers to students in higher education, the kit is designed to support health center staff at all levels. Safe Place is one in a diverse collection of tools commissioned by the White House Task Force to Protect Students from Sexual Assault.



ATIXA Releases New Position Statement

 

ATIXA Position Statement in Favor of Notation of Expulsion and Suspension on College and University Transcripts

 

ATIXA’s Board of Advisors has adopted this position statement in favor of transcript notation for any student expelled for any act of intimate partner violence, stalking and/or sexual violence. By definition, any student expelled for being too dangerous to continue to attend a college is someone whose misconduct should be known to future institutions into which that student might seek to transfer. ATIXA calls on all colleges and universities to adopt a policy on consistent and mandated transcript notation for all such expulsions.

Complying with Campus SaVE and VAWA Section 304

October 1st Annual Security Report Deadline Approaching

By now, many of you have taken a look at the VAWA Reauthorization section known as the Campus SaVE Act. This amendment changes the Clery Act in ways much more substantive than previous amendments. While amendments before asked us to disclose existing policies, they largely did not require us to create new policies except for the set of amendments contained in the 1992 Campus Sexual Assault Victim's Bill of Rights. Now, those disclosures and rights have been largely eclipsed by the SaVE amendments, which will require us to develop significant new policy language, much of the content of which is prescribed by the SaVE Act. Final regulations were released in October 2014 by the Negotiated Rulemaking Committee, requiring changes to the Clery Act effective July 2015.
