AGC MA Launches C&D/Environmental/DEP Liaison Task Force

AGC MA is looking for individuals interested is participating in a new C&D/Environmental/DEP Liaison Task Force. This is the successor to the very active Environmental Committee that existed several years ago to deal with state regs impacting C&D source separation, interaction with DEP, and establishing best practices on recycling, reuse and waste reduction on job-sites.

Why the need for a new Task Force? DEP recently reached out to AGC MA to solicit stakeholder input, experiences and advice as the agency begins to draft a new 2020-2030 Solid Waste Master Plan. DEP invited AGC members, as stakeholders, to the table ten years ago when the first SWMP was being developed for 2010. That interaction spurred the launching of an Environmental Committee that quickly grew into a highly engaged group of individuals that not only advocated for the construction industry but set new standards and recommended practices for waste management on job sites.

We are hoping to do the same with this new request. Please contact Bob Petrucelli at petrucelli@agcmass.org or at 781-235,2680, ext. 14, if you are interested - or if you know of another person in your firm who may be.

Attached is a draft document DEP asked AGC to share with members.

 WHAT YOU NEED TO KNOW

Deadline for Statewide Hot Works certification only 2 weeks away

On January 1st the newest edition of 527 CMR, the State Fire Code went into effect. It requires people performing or involved with the hot work process to be certified by July 1, 2018.  Below is a detailed piece on the requirement, including how it differs from the Boston requirement.  The biggest difference, which is unstated, is the allowance for online certification.

G4S Technology LLC v. Massachusetts Technology Park Corporation

Murtha Cullina's Sara Bryant reviews a highly anticipated Supreme Judicial Court decision that impacts the construction industry and the ability of contractors to collect payment for disputed work in place.  The AGC MA submitted a "friend of the court" amicus brief in this case working in conjunction with other construction industry associations.

A Forged Notary Stamp and the Fake Bonding Company Just Skipped Town...Now What?

By Christopher D. Strang, Strang, Scott, Giroux & Young, LLP, Boston, MA &Brendan Carter, AGC MA

A fundamental piece of public construction projects is the requirement of contractors to provide payment and performance bonds to government contracting entities.  This requirement has its roots in the Miller Act, a Federal statute enacted in 1935 to protect subcontractors from general contractor non-payment and default during the Great Depression...

Owner's Representatives-Emerging Roles, Responsibilities, and Legal Issues

By Anatoly M. Darov, Darov & Associates US PLLC, Boston, MA, Division 12 (Owners & Project Finance)

Over the past two decades, the use of third-party owner's representatives has been steadily growing in all segments of the construction industry.  Given their central role on the owner's side of the project table, owner's representatives have a significant and direct impact on the success or failure of a project.  This article will discuss the role of owner's representatives as well as legal and practical considerations owners and their counsel should be aware of when selecting and contracting with these consultants.

AGC MA LEGISLATIVE & PUBLIC AFFAIRS UPDATE

AGC MA Workforce Development Initiatives

Your AGC MA has invested much time and energy over the past two years on a number of creative Workforce Development initiatives. These range from a comprehensive AGC MA construction industry career development website, www.constructingma.org to safety training at Madison Park Vocational High School; from the Blackstone Valley Educational Foundation (BVEF) and Blackstone Valley Regional Vocational Technical High School to the Fitchburg State University (FSU) with its Construction Technology program.

Understanding the many bills field at the State House dealing with workforce development issues, and the need to promote all the good work construction employer groups are doing,  AGC is in the process of sending an individual letter to every state Senator and House member. The first letters have been sent to Senator Jason Lewis and Representative Paul  Brodeur, co-chairs of the influential Joint Committee on Labor & Workforce Development detailing AGC MA's efforts and accomplishments to recruit and retain new talent to industry.

  SAFETY NOW

Blue Cross and Blue Shield developed an awareness video for Opioid use in the construction industry. We all know that projects are facing the additional challenges of opioids, suicide, and PTSD than in years past and the old slogan of "No Accidents and Everyone Goes Home Safe" is no longer good enough and now needs to include "and returns for the next shift" creating a 24/7 challenge for companies.

Please take 7 minutes to watch this video and feel free to share this link as you see appropriate with your employees, coworkers, and family.

There are currently 333 views on YouTube so let's see if we can boost it to 1,000 by the end on July!

Renovations of Historic Proportions

Colantonio Inc. is performing historic interior renovations and infrastructure system upgrades to the 219-year-old Massachusetts State House Senate Chamber and associated Senate Lobby.

The Senate Chamber, last renovated in 1898, sits directly below the golden dome on the third floor of the oldest and original part of the building, which was designed by Charles Bulfinch.  The work calls for the careful removal, restoration ( M&A Architectural Preservation) and re-installation of the interior architectural woodwork, stained glass and lighting fixtures, along with plasterwork repair and repainting.  The space is also long overdue for accessibility, HVAC, acoustics, and lighting systems upgrades.

Colantonio is charged with protecting the affected areas from construction and delivery impacts and eliminating disruption to State House daily operations while performing all demolition and construction work.

The final completion is projected for January, 2019.
