Compliance: Account Disclosures for NSF Fees
In a recent Risk Alert issued by CUNA, credit unions are encouraged to review their account disclosures and policy for assessing NSF fees on items. Class action lawsuits are being filed against credit unions alleging if the credit union is charging an insufficient funds fee each time an item is presented is a violation of the account agreement. If you charge an NSF fee for an item, each time it is presented and is insufficient, your account agreement should match that practice. CUNA recommends reviewing your account disclosures to ensure you have stated multiple NSF fees may be imposed on the same transaction. This prevents the lawsuits from alleging your have violated your own account agreement.
