California law makes it increasingly difficult for employers to refuse to hire applicants with criminal convictions, even serious felonies.  Refusing to hire convicted criminals in not unlawful, however. It just takes a bit more effort than before. 

This presentation will demonstrate how you may:

  • Lawfully ask about criminal convictions on the employment application and during the interview;
  • What to do if an applicant has one or more convictions; and
  • What to do with an applicant who lies about his or her criminal history.

Capitol Hill is Active Regarding Sexual Harasssment

With the #metoo movement, it should not come as a surprise that the bills dominating the California 2018 Legislative session focuses on sexual harassment. The California Legislature introduced a new bipartisan bill, AB 1870, that would give all employees-not just those claiming sexual harassment-three years to file DFEH complaints of unlawful discrimination, instead of the one year provided by current law.

Lorena Gonzalez, Assembly Member, San Diego introduced bill AB 3080 which would prohibit mandatory arbitration in sexual harassment claims. This bill would also provide whistleblower protection for employees who publicly disclose harassment they endured or witnesses.

Hannah-Beth Jackson, California Senator District 19 introduced SB 1300, which would require all employers to provide two hours of harassment prevention training to all employee within six months of hire and every two years.

Eloise Reyes, Assembly Member, District 47 introduced SB 1867 that would require employers to maintain records of sexual harassment complaints for 10 years. Currently employers are only required to maintain records of harassment prevention training attendees, session trainer(s), training material and attendance dates.

It is recommended that Human Resources should take a proactive approach to identify and address sexual harassment issues within their organization. The best way to protect an organization is to immediately address any sexual harassment claims or suspicions and conduct an investigation, and take the appropriate steps to remedy the situation.

Strategic Business Planning

IE SHRM held a special SHRM workshop on March 24 for Strategic Business Planning - Train the Trainer. We invited IE SHRM members that regularly attend multiple meetings each year - our "frequent flyers." These are members that have shown how dedicated they are to learning, developing and influencing HR in the Inland Empire.

Jon Decoteau, SHRM Division Director West, lead the 8-hour workshop for the 16 attendees. We learned why having a strategic plan is important, the planning life-cycle and how to do a SWOT analysis. We also learned how to implement strategic plans to make the plan work.

Each attendee brought their unique talents and expertise to the workshop. So many ideas flowed into great collaboration. It was exciting to be a part of this energetic group.

We hope to offer other special programs and focused workshops like this one to meet the specific needs of our members. If you are interested in participating in future workshops like this one, please let us know.
