Dr. Jen Welter to Speak at ELC This Year
|
The New Jersey Staffing Alliance's 13th Annual Executive Leadership Conference will be held from April 24-26 at The Borgata Hotel & Casino in Atlantic City, NJ. This is the one event where staffing firm owners and managers can refuel ... recharge ... and reignite their desire to reach peak performance.
With the increasing emphasis on employment fairness, pay equity, social media awareness and office conduct, our committee has brought top speakers to the ELC this year. Over the two and a half day conference, attendees will be inspired by Dr. Jen Welter, the first female to coach in the NFL. In 2015, she served as a linebackers coach for the Arizona Cardinals. When stepping into the biggest challenge of her career, Dr. Welter was given the following words of wisdom from retired NFL Receiver Terry Glenn: "I've been thinking a lot about you going into the NFL, and the best advice I can give you is to be 100% authentic." The pledge to be 100 % authentic framed Welter's time as the first female coach in the NFL.

Avoiding Employee Retaliation Claims
One of the most common lawsuits a staffing firm may encounter are those triggering coverage under Employment Practices Liability Insurance (EPLI). There's exposure with internal office staff, as well as temporary associate or contract staff. NJSA's Positive Impact on Salary History Proposals Being Considered
The Assembly and Senate last year proposed several bills prohibiting employers from asking about an applicant's pay and compensation history until after a bona fide job offer was made. NJSA believed the staffing and recruiting industries' business environments were not adequately considered in the proposed legislature. Therefore in 2017 NJSA communicated with the sponsors of both the Assembly and Senate bills on these issues. These bills were not passed in 2017.
However, similar legislation was filed for the 2018-2019 legislative term and NJSA's Legislative Committee is pleased that the amended Senate version (S-559 Scs) (click here to see a copy) now includes NJSA's recommended language protecting staffing and recruiting firms in the following situations which were not provided for in the original proposals:
An employer having knowledge of an individual's previous salary or wage history obtained as a consequence of prior employment with the same employer is no longer an issue,
Employer inquiries regarding an applicant's previous incentive and commission plans and the terms and conditions of the plans are allowed as long as (1) the employer does not seek or require the applicant to report the amount of past incentive or commission earnings and (2) the employment opportunity being considered includes an incentive or commission component, and
An applicant can provide salary and earnings history to an employment agency if the applicant contacts the agency for assistance in finding employment opportunities. Note the recruiting firm is still restricted from sharing the salary information with potential employers (its clients) without the express written consent of the applicant.

IRS Starts to Send ACA Penalty Letters
The IRS has begun notifying employers of their potential liability for failing to provide health coverage compliant with the Affordable Care Act's (ACA's) shared responsibility provisions. It recently released forms that employers can use to dispute the assessment.
