The Employee Retirement Income Security Act (ERISA) is a regulation that governs welfare benefit plans. A welfare benefit plan under this regulation includes any of the following group or employer offered benefits: health, life, dental, vision, disability insurance plans, flexible spending accounts (FSA’s) health reimbursement accounts (HRAs), employee assistance plans (EAPs) and a few other fringe benefit plans where an employer contributes to the cost.
Under ERISA, employers are required to provide a Summary Plan Description (SPD), which provides participants and beneficiaries with information on the coverage and operation of their benefit plan, including key participation dates, how service and benefits are calculated, when benefits go effective, and how to file claims. The administrator is legally required to send the SPD, free of charge, to all group health plan participants within 90 days after the employee becomes a participant in the plan. An updated SPD must be furnished every 5 years if changes are made to SPD information or the plan is amended.
