On September 24, 2020, the Department of States (DOS) published the monthly Visa Bulletin for October 2020. October 1, 2020 is the start of the federal fiscal year, which has improved some of the backlogs we have been facing.
The U.S. Citizenship and Immigration Services (USCIS) has confirmed that the beneficiaries of employment-based petitions should use the “Final Action Dates” when filing for adjustment of status based on an employment-based petition during the month of October 2020. Currently, only China and India will continue to face visa backlogs in the EB-1, EB-2, and EB-3 categories for the month of October. Mexico and El Salvador will be the only countries facing a backlog in the EB-4 category and China and Vietnam will be the only countries facing a backlog for the EB-5 Non-Regional Center category.
