Premium Processing Resumes for FY19 Cap Cases
  
USCIS just announced that it will resume premium processing on Monday, January 28, 2019, for all fiscal year (FY) 2019 H-1B cap petitions.  That is, H-1B cap cases that were filed in April 2018 and have been pending with the USCIS for 10 months.

If any of your employees have pending FY19 H-1B cap cases that you would like converted to premium processing, please contact me and I will provide you with instructions on what to do.

Under premium processing the USCIS guarantees a 15-day processing time. If the USCIS cannot take certain adjudicative action within the 15-calendar day processing time, USCIS refunds the petitioner's premium processing service fee and continues with expedited processing of the petition.

This service is only resuming for pending FY19 H-1B cap petitions.  Further, premium processing is also available for H-1B extensions (same position with same employer). 

The previously announced temporary suspension of premium processing remains in effect for all other categories of H-1B petitions to which it applied, such as change of employer, amended petition or change in previous position. The USCIS will announce resumption of premium processing for those H-1B petitions as agency workloads permit.
