Expired Product Reminder
Commerce will be working with the State of Ohio Board of Pharmacy to provide information regarding expired product to dispensaries. Please consult Ohio Administrative Code 3796:1-1-01(A)(17), 3796:6-3-01(D), 3796:6-3-06(C), 3796:6-3-07(D), and 3796:6-3-08(G ) . It is important to note the following:

  • Expired product cannot be sold or transferred to a dispensary.
  • Expired plant material can be sold or transferred to a processor.
  • Expired plant material can be extracted, however any manufactured product made from expired plant material must be labeled as such. 
Utilizing eLicensing for Advertising and Packaging Approval

The MMCP has provided a streamlined process to submit advertising, packaging, and labeling for review. The Ohio Department of Commerce requires licensees to upload advertising, packaging, labeling and strain name submissions into e-Licensing for approval.

  • Submitting Advertising: Please log in to the eLicensing system. Once logged in, select “manage licenses” and from there select your facility license. Select on the option labeled “Change Request” which will direct you to the option to request “Advertisement Approval” and “Strain Name Approval.”
  • Submitting Packaging and Labeling: Please log in to the eLicensing system. Once logged in, select “manage licenses” and then click on your facility license. Please note if are a cultivator without a processor license, select your processor-plant only license. You will NOT be able to submit packaging and labeling via your cultivator license. Select the option labeled “Change Request” which will direct the option to select the “Packaging and Labeling Approval.”
Permitted Transactions Reminder
The following specific types of transactions are permitted by law between licensed medical marijuana entities:

  • Cultivators may transfer plant material to a processor.
  • Processors may transfer plant material or manufactured medical marijuana products to a dispensary.
  • Cultivators with a Plant-only Processor designation may transfer plant material to a dispensary.

The following transactions between medical marijuana licensees are not permitted:

  • Cultivator to cultivator
  • Processor to processor
  • Processor to cultivator
Complying with Ohio Bureau of Worker’s Compensation
By Ohio law, employers with one or more employees must have workers' compensation coverage, and those with coverage must keep their policy information updated. The Ohio Bureau of Worker’s Compensation (BWC) may contact new industry members to ensure compliance with Ohio laws.
