Does your organization fall under the Industrial Sector Regulations?

Regulation 851/90 has been amended
The Industrial Establishments regulation (Reg. 851) under the OHSA sets out requirements in Section 13 where guardrails must be installed. Section 13 was recently amended to add a new exemption for a conveyor or similar system, that transports a vehicle or vehicle part and any raised platform used with the conveyor or similar system. The exemption is limited to situations in which a guardrail would obstruct the passage of the vehicle or vehicle part, prevent workers from performing work, or pose a hazard to a worker.

In situations where there is no guardrail, an additional amendment now requires employees to develop and implement other measures and procedures to protect workers from the hazard of falling.

The Ministry of Labour proposed additional amendments. For more information on the legislative amendments, click here.

Distracted Driving

Fines Have Increased!

Regardless of whether you are driving on your personal time or for work, any time that you are driving and have a mobile device in your hand or are not focused on operating your vehicle safely, it counts as distracted driving. This includes times when you are stopped at a red light, at your favourite drive-thru or on any road or highway. The legislative changes also allow an officer to consider all distractions, such as eating, applying
make-up or other distracting behaviours.

As of January 2019, penalties for distracted driving have increased to:

  • First Conviction: Fine up to $1000, three (3) demerit points and three (3) day suspension
  • Second Conviction: Fine up to $2000, six (6) demerit points and seven (7) day suspension
  • Third Conviction: Fine up to $3000, six (6) demerit points and thirty (30) day suspension
