Good afternoon Healthcare Council. It is committee deadline week in the Senate, although that Chamber has notoriously more lax bill extension requirements than the House. The House committee deadline is next week. Spring break in the General Assembly is less than a month away (and not a moment too soon). On to the update!

Last Week in Review
 
  • The Chamber testified against a variety of anti-business healthcare proposals last week, including Sen. Castro's SB1909 (post partum insurance mandate) and Rep. Swanson's long-term experimental antibiotic treatments for Lyme Disease legislation (HB889). The Chamber is working with stakeholders on a potential amendment to SB1909 which would reduce the impact on healthcare costs.
 
  • The Chamber participated in ongoing talks with Rep. Morgan regarding his health insurance rate review legislation, with the new Department of Insurance director attending. No meaningful substance was discussed as it was the Director's third day on the job, but the Department did indicate that they would have feedback and potential language for the bill sponsor to consider.
 
  • The Illinois Environmental Council told the Chamber that they are not proceeding this year with their sharps disposal legislation (HB349). The legislation had raised eyebrows when it was reassigned out of House Consumer Protection and to the House Prescription Drug Affordability Committee.
 
  • House Majority Leader Greg Harris and Senator Andy Manar announced new legislation last week that would create an additional regulatory structure for pharmacy benefit managers. HB465 and SB652 are the vehicles for the amendments. The amendments, among other items, place restrictions on maximum allowable cost price setting and sets up licensure by the Department of Insurance.
 
  • The House Prescription Drug Affordability Committee continued its subject matter hearings last week, with testimony from patients regarding the impact of drug prices, and specifically with regard to insulin. Leader Durkin attended the hearing and spoke of his own experiences in his family, and requested that the committee hear testimony in the future from manufacturers and insurers regarding their perspective.

SB1506 - Mulroe - Repeals a provision requiring the Department of Public Health to enforce provisions regarding the duty of providers of mammography services to provide specific notifications if a patient's mammogram demonstrates dense breast tissue and requires the Illinois Emergency management Agency to enforce the provisions.
 
SB1594 - Sims - Repeals parental notification for abortion.
 
SB1909 - Castro - Amends the Illinois Insurance Code. Requires certain group health insurance policies and other specified policies to provide coverage of medically necessary treatment for postpartum complications as determined by the woman's treating physician. Makes conforming changes in the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act. The Chamber is opposed - the legislation is in response to mortality data provided by IDPH, but many of the solutions will not balance cost containment with improved outcomes.
 
SB1965 - Sims -  Provides that an individual otherwise qualified for and intending to apply for a direct care position who has a disqualifying conviction may initiate a fingerprint-based criminal history record check where a conditional offer of employment has not been made and such a background check has not been previously conducted, and allows those individuals to request a waiver of the prohibition of employment. 
 
SB2094 - Glowiak - Amends the Safe Pharmaceutical Disposal Act. Provides that any county or municipality shall (rather than may) authorize the use of its city hall, police department, or any other facility under the county's or municipality's control to display a container suitable for use as a receptacle for used, expired, or unwanted pharmaceuticals. Effective January 1, 2020.

HB815 - Morgan - Health Insurance Rate Review. The Chamber is opposed. The Department of Insurance indicated to the bill sponsor last week that they are preparing feedback and a potential amendment.
 
HB2042 - Wehrli - reverts short-term medical policy regulation back to original federal standards.
 
HB2162 - Hoffman - Initiative of the Illinois Chiropractors - prevents health insurance plans from discriminating against providers acting within the scope of their license - not being called.
 
HB2189  - Manley - Prevents long-term care insurance and life insurance plans from using seeking genetic testing results. An amendment has been filed that makes the Chamber neutral.
 
HB2347 - Harris - Amends the Managed Care Reform and Patient Rights Act. Provides that specified medical conditions are included in the definition of "emergency medical condition" regardless of the final diagnosis that is given. Provides that provisions concerning emergency services prior to stabilization also apply to the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, and the Illinois Public Aid Code.
 
HB2375 - Batinick - reverts short-term medical policy regulation back to original federal standards.
 
HB2644 - Mayfield - Provides that an insurer or producer authorized to issue policies of insurance in the State may not make a distinction or otherwise discriminate between persons, reject an applicant, cancel a policy, or demand or require a higher rate of premium for reasons based solely upon the basis that an applicant or insured has been convicted of a felony.
 
HB2790 - Yednock - Amends the Illinois Insurance Code. Provides that no insurance company shall require pre-approval or pre-authorization for any treatment determined by a physician to be life-saving. Effective immediately.
 
HB2847 - Conroy - Amends the Organ Donor Leave Act. Provides that an employer shall not retaliate against an employee for requesting or obtaining a leave of absence to donate blood, an organ, or bone marrow. Amends the Illinois Insurance Act. Provides prohibitions on denial of coverage and costs of premiums for living organ donors for life insurance, disability insurance, and long-term care insurance policies.
 
HB3049 - Jones - Amends the Illinois Life and Health Insurance Guaranty Association Law of the Illinois Insurance Code. Provides that an Association must submit a plan of operation to the Director of Insurance within 200 days.
 
HB3081 - Lilly - Provides that hospitals shall provide health insurance coverage to all of their workforce.
 
HB3113 - Cassidy - Amends the Illinois Insurance Code. Prohibits requiring a patient to make a co-payment or a deductible for a dermatology examination. Language has been provided that would narrow the scope and clarify applicability to high deductible health savings account plans.
 
HB3130 - Skillicorn - Amends the Genetic Information Privacy Act. Includes direct-to-consumer commercial genetic testing in the definition of "genetic testing".
 
HB3177 - Mazzochi - Amends the Illinois Insurance Code. In provisions requiring insurance coverage for prostate-specific antigen tests and for colorectal cancer examination and screening, removes provisions requiring the testing be recommended or prescribed by a physician. Also requires insurance policies to provide coverage for testing to establish the presence or absence of sexually transmitted diseases or infections. 
 
HB3188 - Mazzochi - Amends the Illinois Insurance Code. Provides that if an insured is required to pay a deductible or copayment under a policy, an accident and health insurer must disclose to the insured the total actual payments made by the accident and health insurer to a health care provider and the basis for the deductible or copayment the insured is required to pay.
 
HB3323 - Buckner - Creates the Uniform Dental Electronic Transactions Act. Provides that the Act applies to all dental plan carriers. Requires all dental plan carriers and dental care providers to exchange claims and eligibility information electronically using the transactions, companion guides, implementation guides, and timelines required under the Act in order to be compensable by the dental plan carrier. 
 
HB3451 - Yednock - Amends the Illinois Insurance Code. Requires insurance policies to be written in language easily readable and understandable by a person of average intelligence and education. 

HB3471 - Bristow - Amends the Illinois Insurance Code. Requires a group or individual policy of accident and health insurance to provide coverage for cardiopulmonary monitors for a person 18 years old or younger who has had a cardiopulmonary event. Chamber is opposed.
 
HB3472 - Conroy - Amends the Illinois Insurance Code. Provides that a group or individual policy of accident and health insurance shall provide coverage for the cost of opioid treatment drugs, including, but not limited to, opioid antagonists, regardless of whether or not they are generic drug formularies, and other buprenorphine-based medications meant to treat opioid addiction or prevent overdose by opioid use. 
 
HB3473 - Conroy - Serious mental illness early intervention insurance mandate. This legislation will not be called this year - rather look to HB2572 .
 
HB3487 - Ortiz - Amends the University of Illinois Hospital Act and Hospital Licensing Act. Provides that each hospital shall post, in each facility that has an emergency room, a notice in a conspicuous location in the emergency room with information about how to enroll in health insurance through the Illinois health insurance marketplace.
 
HB3503 - Manley - requires hearing aid coverage for insurance plans to cover individuals age 65 and older. Medicare doesn't cover hearing aids - the Chamber is opposed. An amendment has been introduced that would make hearing aids a mandatory offer.
 
HB3509 - Stuart - Pasteurized donated human breast milk insurance mandate. Chamber is opposed.
 
HB3673 - Harper - Amends the Managed Care Reform and Patient Rights Act. Provides that specified medical conditions are included in the definition of "emergency medical condition" regardless of the final diagnosis that is given.

HB1652 - Greenwood - Amends the Departments of State Government Law. Provides that expedited temporary occupational or professional licenses issued to service members and the spouses of service members meeting specified requirements shall be valid for 3 years (currently, valid 6 months) after the date of issuance or until a license is granted or a notice to deny a license is issued in accordance with rules adopted by the department issuing the license, whichever occurs first. Provides that the required fee paid in the application process for an expedited temporary occupational or professional license issued to service members and the spouses of service members shall be refundable (currently, not refundable).
 
HB2328 - Thapedi - Amends the Hospital Licensing Act. Provides that employment agreements between hospitals and physicians may not contain any provision to restrict the ability of a physician to leave employment with the hospital or hospital affiliate and immediately continue to practice in the same field of medicine in the same geographic area.
 
HB2338 - Gabel - Amends the Medical Practice Act of 1987. Provides for the licensure of naturopathic physicians.
 
HB2449 - Gabel - Creates the Home Birth Safety Act. Provides for the licensure of midwives by the Department of Financial and Professional Regulation and for certain limitations on the activities of licensed midwives.
 
HB2474 - Tarver - Provides that, if the Department of Financial and Professional Regulation refuses to issue a license or certificate or grant registration to an applicant based upon a criminal conviction or convictions, the Department shall include in its notification to the applicant an explanation of how the conviction directly relates to and would prevent the person from effectively engaging in the position for which a license, registration, or certificate is sought.

HB2812 - Moeller - Requires the Department of Financial and Professional Regulation to employ an investigator who is required to devote at least 50% of his or her time to the investigation of complaints that allege a violation of the Illinois Optometric Practice Act of 1987 or its rules.
 
HB2813 - Moeller - Amends the Nurse Practice Act. Provides that collaboration does not require an employment relationship between the collaborating physician, podiatric physician, or dentist and the advanced practice registered nurse.

HB3355 - Hoffman - Provides that a physician licensed to practice medicine in all its branches may collaborate with a physician assistant (rather than may delegate care and treatment responsibilities to a physician assistant). 
 
HB3414 - Slaughter - Creates the Prescription Drug Repository Pilot Program Act. Requires the Department of Public Health to establish a prescription drug repository program. Provides that collection efforts shall be performed by the Metropolitan Water Reclamation District. 
 
HB3474 - Yednock - Requires the Department of Financial and Professional Regulation to adopt a standard marketing code of conduct for all pharmaceutical manufacturing companies that employ a person to sell or market prescription drugs or medical devices in the State. 
 
HB3484 - Gabel - Amends the Medical Patient Rights Act. Provides that a patient or representative of the patient must give informed consent, or informed permission in the case of an infant, for biochemical testing for controlled substances unless there is a medical emergency and there is inadequate time to obtain consent. 
 
HB3506 - Villanueva - Amends the Hospital Licensing Act and the University of Illinois Hospital Act. Provides that, except for billing purposes, a hospital may not inquire about a patient's financial status. 
 
HB3684 - Ortiz - Amends the Hospital Licensing Act. Provides that the Department of Public Health may refuse to renew a license if (i) the hospital fails to provide to the Department a copy of its policy adopted under the Language Assistance Services Act, (ii) the Department determines that the hospital is not in compliance with its policy adopted under the Language Assistance Services Act, or (iii) the Department determines that the hospital is not in compliance with the Language Assistance Services Act.

HB53 - Flowers - Requires manufacturers of brand name or generic prescription drugs to notify State purchasers, health insurers, health care service plan providers, pharmacy benefit managers, and the General Assembly of specified increases in drug prices at least 60 days before such increase and the cost of specified new prescription drugs within 3 days after approval by the U.S. Food and Drug Administration. Chamber is opposed.
 
HB156 - Creates the Prescription Drug Pricing Transparency Act. Requires health insurers to disclose certain rate and spending information concerning prescription drugs and certain prescription drug pricing information to the Department of Public Health. Requires the Department and health insurers to create annual lists of prescription drugs on which the State spends significant health care dollars and for which costs have increased at a certain rate over time. Requires the Department and health insurers to provide their lists to the Attorney General. Requires prescription drug manufacturers to notify the Attorney General if they are introducing a new prescription drug at a wholesale acquisition cost that exceeds the threshold set for a specialty drug under the Medicare Part D program. Chamber is opposed.
 
HB349 - Gong-Gershowitz - Sharps disposal program - bill proponent the Illinois Environmental Council informed us last week that they will not be calling this legislation this year.
 
HB891 - Sosnowski - Amends the Illinois Insurance Code. Creates the Pharmacy Benefits Managers Article. Chamber is neutral.
 
HB1441 - Moeller - Creates the Wholesale Importation of Prescription Drugs Act. Requires the Department of Public Health to design an importation program where the State is the licensed wholesaler of imported drugs from licensed, regulated Canadian suppliers. Chamber is opposed.
 
HB2174 - Willis - Amends the Managed Care Reform and Patient Rights Act. Provides that every health insurance carrier that provides coverage for prescription drugs shall ensure that no fewer than 25% of certain individual and group plans offered shall apply a pre-deductible, flat-dollar copayment structure to the entire drug benefit. The Chamber is opposed.
 
HB2638 - Evans - Amends the Illinois Controlled Substances Act. Provides that a prescriber shall offer a prescription for naloxone hydrochloride or another drug approved by the United States Food and Drug Administration for the complete or partial reversal of opioid depression to a patient with certain conditions.
 
HB2880 - Guzzardi - Creates the Prescription Drug Price Increase Tax Act. Imposes a tax on each establishment that makes the first sale of a covered outpatient drug within the State.
 
HB2882 - Guzzardi - Creates the Pharmaceutical and Health Affordability: Restrictions on Manufacturers' Amoral Behavior Through Reasonable Oversight Act. Provides that a manufacturer or wholesale drug distributor shall not engage in price gouging in the sale of an essential off-patent or generic drug.
 
HB3097 - Mah - Amends the Illinois Public Aid Code. Requires the Department of Human Services to develop in collaboration with an academic institution a program designed to provide prescribing physicians under the medical assistance program with an evidence-based, non-commercial source of the latest objective information about pharmaceuticals. 
 
HB3187 - Mazzochi - Amends the Illinois Insurance Code. Creates the Pharmacy Benefit Managers Article. Provides that upon request by a party contracting with a pharmacy benefit manager, a pharmacy benefit manager shall disclose any rebate amounts provided to the pharmacy benefit manager by a pharmaceutical manufacturer. Provides that upon request by a party contracting with a pharmacy benefit manager, a pharmacy benefit manager shall disclose the actual amounts paid by the pharmacy benefit manager to the pharmacy. 
 
HB3246 - Harris - Creates the Retail Store Sharps Disposal Act. Provides that a retail store shall make sharps disposal boxes available at that retail store if it is requested by an employee of the retail store who submits a written request to the manager of the retail store and to the Department of Public Health, requested by the municipality where the retail store is located, or if an infection or contamination from needle exposure is traced back to that retail store by the Department, a local health department, or State or local law enforcement. 
 
HB3493 - Guzzardi - Creates the Prescription Drug Affordability Act. Defines terms. Creates the Prescription Drug Affordability Board and includes provisions regarding: purpose; members; alternate members; conflict of interest; terms; additional staff; salary; compensation and reimbursement; and meetings. Creates the Prescription Drug Affordability Stakeholder Council and includes provisions regarding: purpose; members; knowledge requirements; terms; and compensation. Provides that the Board shall identify specified prescription drug products and determine whether each prescription drug product should be subject to a cost review. Provides that if the Board finds that spending on a prescription drug product creates affordability challenges, the Board shall establish an upper payment limit that applies to all purchases and payor reimbursements.

SB1421 - Murphy - Amends the Fair Patient Billing Act. Provides that before pursuing a collection action against an insured patient for the unpaid amount of services rendered, a health care provider must review a patient's file to ensure that the patient does not have a Medicare supplement policy or any other secondary payer health insurance plan.
 
SB1449 - Morrison - Amends the Illinois Insurance Code. Provides that every insurer that amends, delivers, issues, or renews a group or individual policy or certificate of disability insurance or disability income insurance shall ensure parity for the payment of mental, emotional, nervous, or substance use disorders or conditions. Changes the definition of "treatment limitation" to include benefit payments under disability insurance or disability income insurance.
 
SB1557 - Stadelman - Amends the Illinois Insurance Code. Creates the Pharmacy Benefits Managers Article. Provides that a pharmacy benefits manager may not prohibit a pharmacy or pharmacist from providing a customer with a more affordable alternative if a more affordable alternative is available.
 
SB1633 - Steans - Initiative of Thresholds and other providers - Chamber is opposed. Provides that the Act may be referred to as the Children and Young Adult Mental Health Crisis Act. Amends the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to restructure the Family Support Program (Program) to: (i) enable early treatment of a child or young adult with serious mental health needs; (ii) align the program with system of care principles; and (iii) include both community-based and residential treatment services. Contains provisions on the new hallmarks of the Program; federal Medicaid matching dollars; an In-Home Therapy Pilot Program; and other matters. Amends the Illinois Insurance Code. Requires a group or individual policy of accident and health insurance, or managed care plan, that is amended, delivered, issued, or renewed after June 30, 2020 to provide coverage for: (i) coordinated specialty care for first episode psychosis treatment and (ii) assertive community treatment and community support team treatment. Contains provisions concerning mental health professionals; service payments; and other matters. Makes conforming changes to other Acts. Amends the Substance Use Disorder Act. Requires the Department of Human Services to allow outpatient substance use treatment providers to keep a substance use treatment case open for 90 days when a person has not received a treatment service during such period. Amends the Adoption Act. Requires the Department of Children and Family Services to establish and maintain a toll-free number to respond to requests from the public about its post-placement and post-adoption support services; and to review and update its Post Adoption and Guardianship Services booklet. Requires the Department and the Department of Healthcare and Family Services to coordinate in the development of specified resources. Effective immediately.
 
SB1710 - Ellman - Provides that all entities providing prescription drug coverage shall permit and apply a prorated daily cost-sharing rate to prescriptions that are dispensed by a pharmacy for less than a 30-day supply if the prescriber or pharmacist indicates the fill or refill could be in the best interest of the patient or is for the purpose of synchronizing the patient's chronic medications. 
 
SB1812 - Mulroe -Amends the Insurance Code. Provides that a court shall consider a delay in a company's settling of an insurance-related claim that exceeds 120 days prima facie evidence that such delay is vexatious and unreasonable.
 
SB2026 - Rezin - Prohibits the State from applying for any federal waiver that would reduce or eliminate any protection or coverage required under the Patient Protection and Affordable Care Act (ACA) that was in effect on January 1, 2017, including, but not limited to, any protection for persons with pre-existing conditions and coverage for services identified as essential health benefits under the ACA. 
 
SB2047 - Rezin - Amends the Illinois Insurance Code. Provides that a health insurer that provides prescription drug benefits shall offer generic alternatives to brand name epinephrine and insulin auto-injectors, where available.
 
SB2056 - Murphy - Amends the Illinois Insurance Code. Provides that no individual or group policy of accident and health insurance or managed care organization shall change an insured's eligibility or coverage during a contract period.

SUBJECT MATTER: Patients with Mental Health Diagnosis.
 
HB2486 - Conroy - Creates the Mental Health Modernization and Access Improvement Act. Requires the Department of Healthcare and Family Services to apply for a Medicaid waiver or State Plan amendment, or both, within 6 months after the effective date of the Act to develop and implement a regulatory framework that allows, incentivizes, and fosters payment reform models for all Medicaid community mental health services provided by community mental health centers or behavioral health clinics. 
 
HB2511 - Mazzochi - Creates the Suicide Prevention Act. Provides that for a person 18 years of age or older who is receiving or has received mental health services for an attempted suicide, the person's therapist shall identify a family member or other person who shall consult with the therapist every 30 days following a suicide attempt for the period of one year. Provides that the period may be extended by the therapist based on need. 
 
HB2897 - Flowers - Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department shall investigate and apply for federal funding opportunities, including, but not limited to, a specified federal grant, to support maternal mental health, to the extent that programs are financed, in whole, by federal funds. 
 
HB3091 - Lilly - Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services, in supplying medical assistance, to provide for the legally authorized services of persons licensed under the Professional Counselor and Clinical Professional Counselor Licensing and Practice Act as clinical professional counselors.
 
JCAR Update
Since our last update, new healthcare-related rules have been proposed. IDPH proposed new rules regarding the Alzheimer's Disease and Related Dementias Act, as well as federal regulations on the topic.
