Dear Valued Friends, Clients, and Colleagues:

Thank you for the opportunity to share my excitement in joining the esteemed legal team at Clayton &McCulloh. Even before I left South Florida last week, many of my colleagues there expressed that C&M's reputation for being an experienced, knowledgeable, and service-oriented firm had spread down south. I will certainly maintain those traits with respect to the collection of our clients' past-due assessments. For those with whom I have not yet had the pleasure of communicating, my policy is to be extremely aggressive in collection matters, moving cases forward unless and until an owner pays or is legitimately seeking to resolve the matter in a manner which is acceptable to the Board. Alternatively, if outside activities (i.e., bankruptcy, lender foreclosure, etc.) force an association to step back, I generally continue providing guidance as to the available options to expedite a resolution. Given my experience in the collections field, I understand that past-due assessments are not simply a case on my docket; they are a burden on the entire dues-paying membership of the community, and it is my pleasure to assist you in ensuring they are resolved effectively and efficiently.

"Unpaid County Property Taxes and What they
Mean for Your Community"

Owners who fail to pay their association or mortgage lender often also fail to pay county property taxes, which can result in a tax deed sale and related elimination of past-due assessments. Such taxes accrue annually on November 1st, and are late if not paid by April 1st of the following year. On June 1st, the tax collector can sell a "tax certificate" for the delinquent taxes and interest thereon, at a public auction. The purchaser of a tax certificate (e.g., the county where the property is located, if there are no bidders) may then charge the cost of purchasing the certificate plus interest to "redeem" (resolve and eliminate) the certificate by paying the taxes and interest due.

Embracing Community...
Clayton & McCulloh Plays Santa  (For Pets Too!)
 

If you are one of our regular readers you probably read a touching piece last month about all the hard work we put in to playing Santa for a local class at Howard Middle School (if you missed that story check it out here). However, we didn't stop our community involvement there. At Clayton & McCulloh we have a constant drive to live out our motto of "Embracing Community" to its fullest extent every day. We pride ourselves on being able to truly help members of our Central Florida Community. In addition to helping those students, we also spend time all year collecting donations of all kinds for the "Pet Alliance of Greater Orlando". This year we were able to collect more than double what we had delivered last year. That means more bags of food, more towels, more blankets, and (much to their delight) more cat litter! These animals need our help to ensure that they have everything they need to make it through some of the colder times here in Florida. Marketing Representative, Nathan Knoebber (pictured to the right), was able to drop off all of our donations this year with the help of local volunteers to the pet alliance. Through our partnership with the "Pet Alliance of Greater Orlando", we are able to help our less fortunate furry friends that are too often forgotten despite the love these animals still have to give. Need A Space To Have Your Meeting?
 
We bet you have not been taking advantage of a very special service we offer at our Melbourne Office.  Would you like to host a board or membership meeting somewhere else because:
 
  • You would prefer a low key meeting without distractions;
  • Would like an attorney present for all or part of the meeting;
  • You need a professional setting.
 
Well, we have just the solution for you.  Our large Melbourne conference room located off Wickham Road in the Viera/Suntree area can host up to fifteen people in a professional setting with a screen and projector made available to our clients.  There is plenty of complimentary lighted parking available.  While there is no charge to use the room, there would be a fee for the time that the attorney would be present in the meeting.  When their presence isn't needed, they will retire to another part of the office to work on other matters and you can always call them back in the room if the need arises.
 
This service is especially valuable to our clients if there are sensitive subjects to discuss.  While you can't bar your residents from attending most Association meetings, based on our experience it is rare for residents to attend a meeting at one of our offices.

The March 2018 Official State Approved Board Certification Class 
 
Did you know that the Florida Legislature passed legislation a few years ago requiring every Board Member to take this class?  If you went off the Board for even a day, you must re-take the class.  Or execute an Affidavit stating that you have read, understand your Documents, the ramifications of non-compliance, and agree to enforce your Documents?  Make sure you attend this year's Certification Class to get the scoop on what is expected of you as a Board Member.     

You asked for it - and we are granting your wish.  We feature separate classes for HOAs, Condos/Co-ops, and Mobile Home Parks.  We have updated this course to comply with the yearly changes to the law.  Join us for two hours of preparing you for your role on the Board.

There are several new organizations for members of HOAs, Condos, Co-Ops, and Mobile Home Parks starting their corporate organizational planning in three different areas of Central Florida in the coming months.  They are:

These non-profit groups are in the early stages of organizational meetings.  If you currently serve on a Board of Directors for a Community Association, you are eligible for membership.  Want more information? Apopka Residents - Here's An Organization Just For You!
If your community is in Apopka, there is an organization your Association should consider joining - Apopka Area Council of Neighborhoods Associations (AACONA)!  AACONA meets the 2nd Monday each month at the UCF Business Incubator at 325 S. McGee Avenue in Apopka at 7:00 p.m.  The monthly meetings feature guest speakers from the city, county, and/or private industry.  Members have the opportunity to network with other communities and share possible solutions to problems that they are facing.

Through the years, we have received numerous requests for a set of the Florida Statutes pertaining to Community Associations.  Due to these suggestions, we are now offering the "The Florida Statute Organization Service".  The pertinent Statutes for HOAs, Condos, Co-Ops, and Mobile Home Parks are presented in a binder similar to the featured picture.  Each page is in a sheet protector with tabs separating the various chapters.  The cost of the book is $65.  Each Florida Statue Book is designed just for your type of Community Association (HOA, Condominium, Cooperative, or Mobile Home Park).
 
The books will be ready for mailing in March. Save $15 if you also purchase our Document Organization Service.
