Obtain Summary Judgment

Plaintiff alleged that on August 17, 2016, a bus owned by the Mingo County Board of Education was operated negligently and carelessly causing it to cross into and to obstruct Plaintiff's lane of traffic and that as a result, she was forced to drive off the roadway and crash to avoid hitting the defendant's school bus. Plaintiff was significantly injured as a result of the accident and filed suit against the Board of Education alleging negligence and loss of consortium on behalf of her husband.

At the time of the accident, Plaintiff was driving a company owned vehicle and driving home following the conclusion of her work day. As a result of the accident, she filed a Worker's Compensation claim. The claim was originally denied, but following an appeal by Plaintiff was determined to be a compensable claim. Ms. Tully and Mr. Fuller filed a Motion for Summary Judgment on behalf of the Board arguing that because Workers' Compensation Benefits are available to the Plaintiff, pursuant to W. Va. Code ยง 29-12A-5, the Mingo County Board of Education is statutorily immune from the Plaintiff's claims. Plaintiff then filed a Motion to Amend the Complaint to add the bus driver as a party to the case, which the Board opposed as being futile in nature because the immunity afforded to the Board of Education would extend to the bus driver.

On January 9, 2018, following a hearing on both motions, the Court entered an Order granting the Mingo County Board of Education's Motion for Summary Judgment for immunity and denying the Plaintiff's Motion to Amend the Complaint as being futile in nature.

Kelly Morgan,  Equity Member
In 2000, Kelly C. Morgan graduated cum laude in three years with a Bachelor of Science degree in Human Resource Management from the West Virginia University College of Business and Economics. She then graduated in 2003 from the West Virginia University College of Law at the age of 23 and was a member of the Marlyn E. Lugar Trial Association.  While in school, she was a piccolo player for four years in the "Pride of West Virginia" West Virginia University Marching Band.

Since graduating from law school, Kelly has focused her law practice primarily in the areas of general litigation and insurance defense. From 2004 to 2006, she was associated with the law firm of McQueen, Harmon & Murphy, LC, in Charleston, where she was involved in general defense practice consisting primarily of insurance defense and premises liability for a national retailer.

In 2006, she became associated with the law firm of Bailey & Wyant, PLLC. She currently engages in general and insurance defense litigation in the areas of labor & employment, government liability, product liability, personal injury, deliberate intent, construction, medical malpractice and general negligence. She regularly represents businesses, the State Board of Education, county boards of education, and a variety of other state agencies and political subdivisions.

Kelly is a native of Charleston, West Virginia.  She grew up working in her family's construction business, Welding, Inc., where she learned to handle multiple office responsibilities and the operation of a small business. Kelly C. Morgan is an Equity Member of Bailey & Wyant, PLLC's Charleston office.
