360 Degree Review Use-Developmental or Performance ?
When we assist members with their 360 degree reviews, the conversation typically begins with how they intend to use the results. Should they be used as a developmental tool or an annual review for the individual? Our resounding recommendation is - developmental! While there are other good reasons, the most important one is - confidentiality. This process can only be successful if there is confidentiality involved for the peers and direct reports. If not, the feedback may be less effective as some likely will not feel comfortable being honest.

Substance Abuse and the ADA
Danny L. Caudill, Esq.
Learning and Compliance Consultant

The Americans with Disabilities Act (ADA) protects workers from discrimination based on a qualifying disability or a perceived disability-including alcoholism and past illegal drug use. That said, employers don't have to accommodate any alcohol or illicit drug use in the workplace. They simply must be careful not to discriminate against workers with a history of substance abuse, who are no longer using.

Does Your Company Need an FMLA "Checkup ?"
Michelle Pinsky, MILR
HR and Compliance Consultant

We receive all kinds of questions on the hotline. But I have to say, the number one topic continues to be FMLA! The basic eligibility rules under the Family and Medical Leave Act (FMLA) seem pretty straightforward right? If an employee worked for the company for more than 12 months, has logged more than 1,250 hours in the past 12 months, and is employed at a worksite where the employer employs 50 or more employees within 75 miles, he or she is entitled to leave. So what is so confusing?

The 'I Want One Too' Era - Where's My Raise ?
Monique Kahkonen, SCP, SPHR
Vice President, HR Advisory Services

We've all heard about the companies who are providing one-time cash bonuses, boosting hourly pay rates, and even increasing matching contributions to employees' 401k plans because of the windfall expected from businesses paying less taxes in coming years.  Given this, a popular question from our members has been, should I be doing this too to keep pace with my competition?  Should we adjust our ranges given the current pay increases?
OSHA Electronic Electronic Reporting Requirements
Compliance Update
John Valentine
Safety and Risk Consultant, RiskControl360

Between February 1st and April 30th 2018 all employers covered by the recordkeeping regulation must post a hard copy of their 2017 OSHA 300A in a common area of their workplace that employees can readily access and observe it. This requirement is nothing new for employers and has been required in years past. For employers of certain sizes and industries an additional requirement of electronic reporting has been added with a deadline of July 1st, 2018.  To determine your establishments' responsibilities in reference to the electronic reporting standard first determine which category below that your establishment belongs to.
