Preparation for California's New Paid Sick Leave

 

As you've heard, California's new paid sick leave law (AB 1522, also known as the Healthy Workplaces, Healthy Families Act of 2014 or "HW/HF") was effective on January 1, 2015. The most critical part of the law becomes effective on July 1, 2015 wherein all employees must begin earning paid sick leave under an accrual or a front load method. The law requires employers to grant all employees an accrual of one hour for every 30 hours worked; or front load 24 hours or 3 days each 12 month period.

 

We will be working with our retained services clients to assist in determining the best approach to take in complying with the new law. There are several "moving parts" to the law and more parts that are yet to be clarified by the Department of Labor Standards Enforcement (DLSE). Even if your employees currently receive paid sick leave, the new law includes provisions and requirements that your policy and practices likely do not reflect. Employers should not assume that as long as all employees are granted 24 or more hour of sick leave annually that everything is "good to go" for HW/HF compliance.

Don't Even Think About It...

 Questions asked by employers who rarely like the answer.

As HR consultants we work with hundreds of California employers. They call us to think out loud about employee performance issues, leave of absence dilemmas, compensation challenges, bad behavior, and how to keep the superstars. Here are a few of the questions we receive that almost invariably have the same answer - "Don't even think about it." The brief explanation below is written for the layperson - the one who just wants to stay out of court.

 

  • I have this new employee who has missed a lot of work and now tells me she's pregnant. Can I fire her before her introductory period is up?

5 Ways You Can Be A Better Leader Today

"Leadership is the art of getting someone else to do something because HE wants to do it." ~Dwight D. Eisenhower.

 

There are two approaches to getting what you want. I call these two methods Push and Pull. 

 

Push is, predictably, being pushy. Pushing looks like demanding, intimidating, pleading, manipulating. When you push, you are trying to get them to do it because YOU want them to do it.

 

Pushing can get you what you want in that moment; but it will never get you more than you ask for. Bosses who Push get the bare minimum from their employees; just enough to keep their jobs. When parents push, they get kids who stick to the letter of the law, but do their best to avoid delivering on the spirit of the law; they hide their broccoli under their napkin, or they push their toys under the bed in order to "clean their room."

 

The thing is, Pushing pushes people apart. Pushing ruins relationships. If your employees are spending their work-time on monster.com, if your kids move out as soon as they are able, if you're marriage has more resentment than love, you've been a busy Pusher.

 

As General Eisenhower said, there is another way.
