The proposed rulemaking package initially noticed on July 13, 2018, was submitted to the Office of Administrative Law (OAL) for review on December 3, 2018. The California Department of Public Health has posted on its website, www.cdph.ca.gov/mcsb/rulemaking, the following documents:
  • The draft regulation text that was filed, with strike outs and underlines that reflect the differences between the regulations under review and the current regulations
  • The final statement of reasons

The public comment period has closed for these regulations, and the cannabis licensing agencies will not be providing guidance related to these regulations until OAL has completed its review. 

Please note that the regulations submitted to OAL have not been approved and are not in effect. While the regulations are under review with OAL, the emergency regulations remain in effect and licensees must continue to comply with those regulations.

About the Manufactured Cannabis Safety Branch

The California Department of Public Health’s Manufactured Cannabis Safety Branch (MCSB) is one of three state cannabis authorities charged with licensing and regulating commercial cannabis activity in California. MCSB regulates all commercial cannabis manufacturing in the state and strives to protect public health by ensuring commercial cannabis manufacturers operate safe, sanitary workplaces and produce products that are free of contaminants, meet product guidelines and are properly packaged and labeled.

The state cannabis authorities adopted emergency regulations for initial implementation of the provisions of Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA)and are now using the regular rulemaking process to adopt permanent regulations.
