Michigan Supreme Court Invalidates
Governor’s Emergency Authority

This evening, the Michigan Supreme Court issued a split decision that invalidates the Emergency Powers of the Governor Act and rules that Governor Gretchen Whitmer did not have authority to declare the state of emergency pertaining to the COVID-19 pandemic after 4/30/20, the last date that the Legislature acted to authorize the declarations.

The ruling removes the authority on which all executive orders related to the pandemic issued after 4/30/20 rest. The Governor now has to work with the Legislature on the next declaration of a state of emergency.

The Court’s order does not take effect for 21 days and, during that time, the Governor’s declaration of the state of emergency and all orders pertaining to it continue to have the force of law. MMA members should continue to follow the safety, COVID screening and other operational orders through Friday, 10/23/20.
