47th CCIL Annual Conference 
Le congrès annuel du CCDI se tiendra du 

1 & 2 novembre 2018

The 47th Annual CCIL Conference will be held in Ottawa on Thursday, November 1 and Friday, November 2, 2018.

The theme of this year's conference is "International Law at the Boundaries". A call for papers and panel proposals will be circulated soon. 

This year will feature a dynamic mix of new research, practitioner perspectives, and keynote addresses from prominent figures in international law, along with ample opportunities for networking and dialogue.


Le 47e congrès annuel du CC D I se tiendra à Ottawa, jeudi, le 1er novembre et vendredi, le 2 novembre 2018.  

Le thème de cette année sera "Le droit international aux frontières".  Un appel à communications et de propositions de panels sera circulé prochainement. 

Le congrès de cette année présentera de nouveaux domaines de recherche, de perspectives par les praticiens du droit et d'allocutions de personnalités éminentes en droit international, ainsi que de nombreuses occasions de réseautage et de dialogue.

Le Cercle étudiant de la Société québécoise de droit international (SQDI) tiendra son 4e Colloque pour étudiant-e-s des cycles supérieurs et jeunes chercheur-e-s le mardi 27 mars 2018 à l'Université McGill. L'objectif premier de ce colloque est de permettre aux étudiant-e-s des cycles supérieurs, aux diplômé-e-s récent-e-s et aux postdoctorant-e-s de présenter leurs travaux de recherche en droit international public et privé. Ce colloque vise la stimulation des échanges sur des thèmes d'intérêts communs et le développement de liens entre étudiant-e-s de différents horizons. Le programme sera disponible sous peu sur les réseaux sociaux ainsi que sur le  site web de la SQDI.


International Justice and Victims' Rights Summer School |

Le Partenariat canadien pour la justice internationale organise l'école d'été Justice internationale et les droits des victimes, qui se tiendra à Montréal du 4 au 9 juin 2018.

Cet événement rassemblera des experts de renommée internationale et des organisations de défense des droits humains, afin de discuter et de réfléchir sur les questions relatives aux droits des victimes et à la justice internationale. 

Ce cours vise à former et à engager des étudiants et des professionnels dans les domaines du droit, de la criminologie et des disciplines connexes à des questions clés concernant les droits des victimes d'actes criminels et d'abus de pouvoir.

À chaque jour de cette semaine de cours, deux conférences d'experts seront présentées. De plus, des visites au Centre Raoul Wallenberg et un rencontre avec un représentant du Centre canadien pour la justice internationale sont prévues.

Notez que l'école est bilingue (français-anglais). Il est attendu des étudiants qu'ils parlent couramment le français ou l'anglais et à qu'ils aient au moins une compréhension passive de l'autre langue. The Canadian Partnership for International Justice organizes the International Justice and Victims' Rights summer school, which will be held in Montreal June 4-9, 2018. 

This event will bring together internationally renowned experts and human rights organizations in order to discuss and reflect on issues surrounding victims' rights and international justice. 

This course serves to train and engage students and professionals in the areas of law, criminology, and related disciplines in key issues regarding the rights of victims of crime and abuse of power. 

This week long course consists of daily lectures by experts. In addition, a visit to the Raoul Wallenberg Center and a meeting with a representative from the Canadian Center for International Justice are scheduled. 

Please note that the school is bilingual (French-English). Students are expected to be fluent in French or English and to have at least a passive understanding of the other language. For more information, please click  here.

L'édition 2017-2018 du concours Matthieu-Bernard, organisé par la Société québécoise de droit international, invite les étudiant-e-s du baccalauréat et des cycles supérieurs de tous les programmes de droit et d'études internationales du Canada à rédiger une dissertation (en français ou en anglais) ayant pour thème « Le droit de retour en droit international ». La participation se fait seul ou en équipe. Le prix du concours est la publication du manuscrit dans un numéro régulier de la Revue québécoise de droit international (conditionnelle à l'approbation préalable du Comité de lecture de la Revue) et une bourse d'études de 500 $. Les directives relatives au concours sont disponibles en ligne sur le  site de la SQDI .

The NYU Stern Center for Business and Human Rights and the Global Business and Human Rights Scholars Association invite you to submit papers:
  
Scholars from all disciplines are invited to apply, and we invite contributions that reflect the interdisciplinary character of BHR in theory and in practice. We will also consider applications to participate as observers and discussants. Anyone interested in this possibility should submit their application in a few sentences to the email address below.

Doctoral candidates are not eligible to present their research at this workshop, but they are welcome to attend. To discuss their work, PhD students may apply to the Young Researchers Summit (https://bhr.stern.nyu.edu/youngresearchers/). 

This is a workshop to discuss research-in-progress; papers must be unpublished at the time of presentation. In addition to presenting a paper at the conference, participants are expected to read and be prepared to comment on and discuss the papers of other participants. The conference will be organized around three parallel working groups. 

How to apply:

Please indicate in your application to which of the three broad tracks you would like to contribute: (1) preventing, managing, and measuring BHR; (2) human rights in global supply chains and specific industry settings; or (3) conceptual approaches to BHR. To apply, please submit an abstract of no more than 250 words to [email protected] with the subject line Business & Human Rights Conference Proposal. Please include your name, affiliation, contact information, workshop theme preference, and short curriculum vitae.

The proposals will be assessed by an organizing committee comprised of Dorothée Baumann-Pauly (NYU Stern, Program Chair and head of the committee), Justine Nolan (University of New South Wales), Penelope Simons (University of Ottawa), Kish Parella (Washington & Lee School of Law), Karin Buhmann (Copenhagen Business School), Merryl Lawry-White (Debevoise & Plimpton LLP), César González Cantón (CUNEF, Madrid), Humberto Cantú Rivera (University of Monterrey), Stephen Park (University of Connecticut), Michael Santoro (University of Santa Clara, President of the Global Business and Human Rights Scholars Association) and Anita Ramasastry (University of Washington School of Law, Vice-President of the Global Business and Human Rights Scholars Association). 

The deadline for submission of abstracts is March 1, 2018. Scholars whose submissions are selected for the symposium will be notified no later than March 15. Full papers must be submitted by August 1.

The 46th annual CCIL Conference was held November 2 & 3, 2017 in Ottawa. Attended by more than 300 delegates and speakers, the CCIL was very pleased with the continuity of this tradition. A meeting of more than 300 people; academics, students and practitioners working in various spheres to discuss the theme "Canada at 150: The Return of History for International Law" and the challenges to the principles and institutions of the international order.

Canada's Embrace of the EU-Inspired "Investment Court System":  Foresight or Folly

In Ottawa on November 2, 2017, at the annual conference of the Canadian Council on International Law, the Honourable Charles N. Brower delivered a keynote address. Judge Brower, who is judge ad hoc for the International Court of Justice and arbitrator for the International Centre for Settlement of Investment Disputes, forcefully responded to governments' main arguments for eliminating the investor-state dispute settlement (ISDS) clause included in international investment agreements. He also analyzed the challenges arising from the creation of an investment court system as provided for in the Canada-European Union Comprehensive Economic and Trade Agreement (CETA). 

Judge Brower began his keynote speech by underlining that criticism of ISDS clauses has increased in recent years. This criticism now has global reach, as governments, among other actors, mistrust the current mechanism. Indeed, there is a growing opposition from States towards the inclusion of an ISDS clause in investment agreements, presumably to avoid being brought before arbitration tribunals. Judge Brower suggests that this wave of protest should be deemed a "demolition derby", as it seeks to irreparably narrow the scope of investment treaties through the dismantling of the ISDS clause. Should Canada champion a North Atlantic free trade agreement? This year's recipient of the John E. Read medal was Professor Armand de Mestral, an expert in international trade law. The presenter of the award, Professor Céline Lévesque, stated that three main factors explained why Professor de Mestral's career was being recognized by the Canadian Council on International Law (CCIL), namely, his significant contribution to international law, his generosity as a mentor to generations of scholars, as well as his lasting involvement with the CCIL.  Read more

Comme le thème de la conférence est ''le retour de l'histoire pour le droit international'', il est intéressant d'étudier l'évolution du droit canadien en ce qui concerne les crimes contre l'humanité. Le Canada a l'habitude de réprimer les crimes de guerre et criminels avec une approche centrée sur des mesures d'immigration, plutôt que sur des mesures pénales. L'extradition est ainsi devenue l'outil le plus populaire lorsque vient le temps de punir un criminel de guerre se trouvant en sol canadien. Cette tendance a pris de l'ampleur depuis la première extradition pour crimes de guerre en 1982. La Cour suprême de l'Ontario avait alors autorisé le renvoi du présumé criminel de guerre nazi de 73 ans, Albert Helmut Rauca, accusé de l'exécution de 11 584 personnes durant la Seconde Guerre mondiale. En 1985, la Commission d'enquête Deschênes sur les criminels de guerre fut créée et permit d'accuser quatre personnes entre 1987 et 1992 en vertu du Code 2 criminel. Or, ces quatre personnes furent toutes acquittées et les poursuites pénales redevinrent de plus en plus espacées. Plus...

CCIL & CAIDP Joint Event on Gender Equality, Inclusive Governance and the Law

Ottawa, January 23, 2018

The Canadian Council on International Law (CCIL) in collaboration with the Canadian Association of International Development Professionals (CAIDP) organized a joint event on January 23rd 2018 in Ottawa.
 
This event brought together policy makers, international law and development practitioners, and academics to exchange views on and the latest and discuss implications on foreign policy priorities and gender equality.  For CAIDP and CCIL, our collaboration was a first for the two constituencies.

Le Regroupement des professionnels canadiens en développement international (RPCDI) en collaboration avec le Conseil canadien du droit international (CCDI) ont organisé un événement le 23 janvier 2018.

Le RPCDI et le CCDI étaient ravis de rassembler les décideurs politiques, les praticiens du droit international et du développement et les universitaires pour échanger au sujet des développements récents et discuter des conséquences des priorités qui sous-tendent la politique étrangère du Canada et l'égalité des genres

2nd Annual International Humanitarian Law conference

On October 27, 2017, in partnership with the Canadian Red Cross, the College of Law at the University of Saskatchewan hosted the 2nd Annual International Humanitarian Law conference, "Humanizing Warfare: Successes and Challenges with Implementing the Law of Armed Conflict".
 
With approximately 100 registrants, the conference was well attended and provided an opportunity for attendees to hear from a variety of engaging speakers: Jonathan Somer, Interim Senior Legal Advisor on IHL for the Canadian Red Cross provided an overview of IHL and discussed his experience educating non-state actors regarding IHL obligations; Andrew Carswell, Senior Delegate to Canada with the International Committee of the Red Cross, discussed training state armed forces on IHL; Professor Chris Penny from the Norman Paterson School of International Affairs at Carleton University spoke about negotiating arms control treaties, including his experience with negotiating the Convention on Cluster Munitions; while Professor Joanna Harrington from the University of Alberta Faculty of Law examined accountability issues and enforcement of IHL obligations.  Professor Karinne Coombes from the University of Saskatchewan's College of Law moderated a Q&A session to conclude the conference, during which attendees asked thoughtful and challenging questions of the panellists.  Feedback from attendees was universally positive and showed that the conference achieved its goal of increasing awareness of IHL issues among students, academics, and the general public.
 
For the second year, the Canadian Council on International Law assisted with funding the conference.
