URGING THE CITY TO FIGHT: MITCHELL CASE
Prior to Mitchell vs. City of Los Angeles, the City had established some limits on the amount of property that a person can have on the sidewalk. The City was immediately sued (Mitchell vs. City of Los Angeles) and the City stopped enforcing these limits under code 56.11.

In 2016, a U.S. district court judge ruled the city of Los Angeles to stop seizing property of homeless people without providing notice or storing the items. This current injunction only applies to Downtown, specifically from Spring Street to Alameda Street and 3rd to 8th Streets, and this could be made permanent through a settlement agreement.
Along with a coalition that includes other Downtown BIDS, CCA, Weingart Center, Midnight Mission, Union Rescue Mission, and Chamber of Commerce, we are asking the City to go to trial and not settle. Settling the case by any means could permanently remove the current 60-gallon limit on the amount of property a person has on a sidewalk. Going to trial would mean a chance for the City to show the progress it has made with ending homelessness and expressing the possible issues that may arise with settling.
