President's Message
As we bask in the afterglow of Thanksgiving and begin to prepare for Christmas, let’s remember that we all have much for which to be thankful! We still live in the greatest country in the world. Despite our time’s rancor, we can celebrate that the United States Constitution gives its citizens the right to express wildly different points of view. We are also fortunate to be members of the
MOBILE BAR ASSOCIATION (MBA)
. Our association is the oldest in the State of Alabama and the fourteenth oldest in the nation. In 2019, we will celebrate our 150
th
anniversary. Our association boasts a membership rate of about eighty-five percent. In other words, about eighty-five percent of the lawyers licensed to practice in the Mobile area are members of the MBA. That is a very high percentage for voluntary bar associations in the U.S.; it is a testament to the dynamism of the MBA and its hard-working staff.
It has been a tremendous honor for me to serve as your president. I have learned a great deal and that knowledge has made me even prouder of our organization and its members. I encourage you to become active, or more active, in the MBA - you, and we, will be enriched for your efforts. At our monthly luncheon on December 14, 2018, we will celebrate our profession, our organization and our members. The December lunch always leaves me feeling warm and fuzzy and not just because of the egg nog and wine! That is when the
MOBILE BAR FOUNDATION
, the charitable arm of the MBA, makes its grants. The Foundation’s fundraising this year was outstanding and its grants assist a broad range of local organizations that benefit our community.

Reflection
. December is always a busy month. There are the end-of-the-year projects to complete, holiday gifts to purchase for friends and family and holiday parties to attend. It’s hard to keep our routine normal. Even though there is the hustle and bustle of the season, it is also important to take time to reflect on the past year. Did you accomplish the goals you established at the beginning of the year? Were you on time? I did a great job on what projects? I did not meet expectations on that project?
Personal reflection helps us to process and make meaning of all the great (and not so great) personal and working experiences we’ve had. Everyone can gain from engaging in some form of reflection. To me, it is considered to be an essential part to make the most of any experience.
The definition of reflection from The Random House dictionary -
Reflection is a serious thought upon a subject.
I recently read an article on this subject. In the article, it shares that researchers have found that reflection can improve understanding of the context you work in, transform perspectives, deepen understanding and help you re-appreciate the job you do. (Glaze, 2001).
We must reflect on both our successes and our failures. Reflection is not about dwelling on the negative things. Our positive experiences can teach us what works well in certain situations and allows us to examine potential improvements in other situations. The article states that reflection can’t and shouldn’t be forced. Start in small increments: five to ten minutes daily or taking 30 –minutes once a week.
The article shared a model created by Graham Gibbs that breaks down the process of reflection into meaningful and manageable steps. The model contains six steps: description, feelings, evaluation, analysis, conclusion and action plan. The exercise can be used in full, skipping steps and repeating as needed. This model can be used both on an individual or group level. Please email me if you would like a copy of Gibbs’ reflective cycle.
Reflection is a powerful tool for finding meaningful information, both personally and professionally. Remember, take time to reflect on your successes and failures. It could be the difference in making the project successful or not successful.

MICKEY SMITH
died on October 15, 2018. A resident of Theodore, he received an honorable discharge from the United States Navy on January 8, 1946. He was a member of the Elks Lodge 108, American Legion, Azalea Ballroom Dance Club and the ROMEO’s. He is survived by his wife of sixty-eight years, two children, four grandchildren and four great-grandchildren.

and friend of the MBA died on October 18, 2018. “Mr. Bill” was an avid traveler and was active at Wilmer United Methodist Church as well as other civic and charitable organizations. Many MBA members will remember him fondly from the years he worked as Bailiff for

. He followed many different vocations and was known for his gruff but gregarious and generous nature. He is survived by his wife of fifty-seven years, two sons, and three grandchildren.

died at home on October 29, 2018. “Shrimp” was a native Mobilian who attended Sweetbriar College and graduated from the University of Alabama. She loved Mobile Bay, sailing, community work, and reading and was an accomplished writer. She was an active member of All Saints Episcopal Church and, later in life, at St. Paul’s Chapel in Magnolia Springs. She was preceded in death by her husband and survived by her five children, sixteen grandchildren, and three great-grandchildren.

In what appears to be a case of first impression, the Supreme Court in
Ex parte Estate of Elliott,
No. 1170564 (Ala., September 7, 2018), issued a writ of mandamus reversing a trial court’s order denying in part a motion to compel when the objection to the discovery was various grounds of privilege but no privilege log had been voluntarily produced by the defendants or required by the trial court and no factual detail was provided on which the court could property evaluate whether any privilege applied.
In another case of first impression, the Supreme Court in
Ex parte Birmingham Airport Authority
, No. 1170592 (Ala., September 28, 2018), held that when a statute provided immunity from liability for “tort” in favor of a governmental entity, that immunity included claims for wantonness in addition to claims for simple negligence.
In
Healthsouth Rehabilitation Hospital of Gadsden, LLC v. Honts,
No. 1160045 (Ala., September 28, 2018), the Supreme Court held that a medical malpractice defendant was entitled to a new trial after concluding that the trial court had charged the jury based on the standard of care applicable to a specialist when the alleged tortfeasor (who was never formally identified) could only have been a non-specialist. This ruling effectively reversed a $20,000,000 verdict in favor of the plaintiff estate in a wrongful death matter.
In a split decision on an issue of first impression, the Supreme Court in
GHB Construction and Development Co. v. West Alabama Bank and Trust,
No. 1170484 (Ala., September 21, 2018), held that no mortgage lien was created against a piece of real property until funds were actually advanced by the lender and refused to hold conclusive that once funds were advanced the lien related back to the date the mortgage was recorded. Accordingly, the Court reversed the dismissal of a complaint by a materialman who filed a lien after a future-advance mortgage was recorded but before any funds were advance by the lender claiming that its materialman’s lien had priority over the mortgage. The Court noted generally that mortgages containing future advance clauses were valid but acknowledged no prior precedent in which a future advance mortgage was recorded where no actual funds had been lended.
In a case with one dissenting vote, the Supreme Court in
Burns v. Ashley
, No. 1170565 (Ala., September 28, 2018), affirmed much recent precedent and held that a will contest could not be removed from probate court to circuit court under Ala. Code § 43-8-198 unless the probate court entered an order granting the removal and that an estate administration could not be removed from probate court to circuit court until after an administration had begun.
