The Michigan Department of Licensing and Regulatory Affairs (LARA) and Michigan Department of Health and Human Services (MDHHS) have issued new and revised rules as part of the ongoing effort to fight Michigan's opioid crisis.

Public Act 247 of 2017, MCL § 333.7303a(2), requires that except as provided in exceptions detailed in administrative rules, a prescriber must be in a bona fide prescriber-patient relationship with a patient before prescribing a schedule 2-5 controlled substance ("CS"). The Michigan legislature delayed the effective date of the bona fide prescriber-patient relationship requirement to the earlier of (a) March 31, 2019, or (b) the date administrative rules describing the exceptions to the requirement are promulgated. Public Act 247 also requires the prescriber to provider certain follow-up care to the patient to monitor the efficacy of the CS in treating the patient's medical condition. Failure to comply with the bona fide relationship requirement is considered professional misconduct and may subject the prescriber to professional discipline.

The Michigan Department of Licensing and Regulatory Affairs ("LARA") has now published a rule, effective January 4, 2019, describing exceptions to the bona fide prescriber-patient relationship requirement. Promulgation of this rule means that the bona fide prescriber-patient relationship requirement of MCL § 333.7303a is in effect as of January 4, 2019, for all practitioners who prescribe schedule 2-5 CS.

MDHHS emergency rules on opioid overdoses
The MDHHS emergency rules require hospitals to report opioid overdose statistics upon request. The rules are meant to inform the public health response to the substantial increase in cases of prescription and illicit drug overdoses. The MDHHS has released a set of Frequently Asked Questions relating to the emergency rules and the development of a permanent rule.
Gabapentin is a Schedule V controlled substance in Michigan
Effective January 4, 2019, the Board of Pharmacy Controlled Substances Rules were revised to include gabapentin under schedule V thereby limiting the prescribing and dispensing of gabapentin to those registered with the Drug Enforcement Administration (DEA).

Dean says College of Osteopathic Medicine is a place where the science and art of medicine meet
Dr. Andrea Amalfitano, the new dean of Michigan State University's College of Osteopathic Medicine, is featured on WKAR in an interview with Russ White.
"It's humbling and also thrilling at the same time to know that the faculty and staff of the college have enough confidence in me to proceed forward as the permanent dean," says Amalfitano. "The other faculty and staff at the university and other deans have been tremendously supportive. Our alumni, our external partners, the Michigan Osteopathic Association, and a number of groups outside of the college all came together. I feel like I have the support of thousands as we go forward to produce the best physicians in the country."

The Michigan Loan Reimbursement & Employment Solution (MiLES) offers $50,000 in tax-free loan repayment to physician residents during their residency in exchange for a 2-year post-residency service commitment in a medically underserved area of Michigan.
MiLES will be accepting applications January 2 - February 28 of 2019.
The program will match employers with providers who would like to stay in the community beyond their 2-year service commitment.
Employers, there is no cost to post jobs or to participate in the program.

Physician-Focused Payment Model Technical Advisory Committee
Value Considerations for Model Development and Testing
The Medicare Access and CHIP Reauthorization Act of 2015 established an innovative process
for stakeholders and individuals to submit proposed physician-focused payment models to an
advisory committee, the Physician-Focused Payment Model Technical Advisory Committee
(PTAC). PTAC's statutory mandate is to make comments and recommendations to the Secretary
of the Department of Health and Human Services (HHS) on the extent to which each submitted
proposed model meets criteria established by the Secretary for physician-focused payment
models. Submitters and PTAC thus have an important role to play in the advancement of value-based care.
BCBSM is making a change to prior authorization requirement for PPO members
In October, Blue Cross Blue Shield of Michigan (BCBSM) announced physicians would need to obtain prior authorization for high-tech radiology, in-lab sleep management and echocardiogram services for all Blue Cross Blue Shield of Michigan PPO members, regardless of where they lived. BCBSM subsequently changed its approach and will only require prior authorization for those services for patients who live in Michigan.

The term is used a lot, but when it comes to health care, arriving at an agreed-upon definition of value can be difficult. Many different stakeholders - doctors, hospitals, patients, employers and health care plans - have differing visions of what constitutes value in health care. What's more, they often have conflicting goals, needs and expectations.

Coalition Protecting Auto No-Fault - Year in Review
In 2018 the Coalition Protecting Auto No-Fault (CPAN) faced many challenges in protecting Michigan residents. The coalition was able to fight several efforts by the insurance lobby that would have left Michigan residents with less protection, with no guarantees of common sense rate reductions.
2019 will present more challenges. The Michigan Osteopathic Association is proud to partner with CPAN in standing up for Michigan residents and working for common sense insurance reform, while still maintaining protection that ensures quality healthcare in a catastrophic accident.
