WHAT'S SELLING AT THE BLUFFS                                             October 2018   Vol 84
It's a Great Time to Buy a Bluffs River Home
 
People frequently ask me if there is a price difference between the Ridge at the Bluffs and the Bluffs River single family homes?
 
My answer is, "Yes". Over the last two years, the average sales price in the Ridge was $38,953 higher than the average sales price in the River. The average sale for the Ridge over the last two years was $530,000 vs. the average sale in the River for the same period was $491,886. This equates to a little more than a 6% difference in price between the two communities compared to a 1.7% percent difference or $8,928 lower per average sale back in 2005. Perhaps one reason for the difference is the proximity to the beach; however, my professional opinion is a significant difference in the prices is because since mid-2006, the Ridge started allowing homeowners different options for house colors. It's hard to believe it's already been 12 years since I lobbied for and assisted the Ridge ACC Committee to implement various color schemes. Other approved improvements that shortly followed the painting in the Ridge were brick paver options, custom gates, custom landscaping and front yard lighting.  These changes have proven to be a great decision! To date, more than 500 of the 618 homes have been painted in the Ridge. The good news is the River is now offering some personalized options as well, and the HOA Board is currently working on offering more choices. They now allow exterior lighting choices, gate options, and some different paver options for the walkways and driveways. They are currently exploring options with exterior painting now, and it can only get better from there!  Thus, this may be a very good time to purchase in the River now, as I foresee the pricing gap closing in the near future with these changes being implemented.
 
These changes are not only occurring in The Bluffs Communities; This trend is happening in other local HOA subdivisions as well where I have observed more roof options and added new painted color schemes.

Q:  If I have a lien on my property will that prevent me from selling it?.
 
A: Maybe. Property liens come in many forms.  They can be in the form of a mortgage by a lender, a money judgment by a creditor, a claim of lien by a contractor, a code enforcement lien by a municipality, a tax lien by the local taxing authority, or an IRS tax lien, to name a few.  Generally, liens are recorded in the public record of the county where the property is located.  The act of recording the lien in the public record makes the lien an encumbrance on the subject property.
 
If your property is homesteaded as provided by the Florida Constitution, then you can usually avoid paying a money judgment from the proceeds of the sale. 
 
However, Florida's homestead protections will not serve to avoid paying off a mortgage lien, a claim of lien by a contractor, or a tax lien.  These liens must be paid at closing in order for the seller to convey clear title to the buyer.
 
When the title company performs a title search, these liens typically become known.  The closing agent will usually work with the seller and attempt to clear these liens (pay them on the seller's behalf) so that the seller can convey clear title.
 
If a transaction does not have enough "equity" to cover the cost of the lien, or if a seller does not have the money to pay the lien, all hope is not lost.  A seller can try to negotiate with the lien holder to reduce the lien amount.  A seller can also try to negotiate with the buyer to cover some of the expense of clearing the lien.
