Is Your Association Running Out Of Time? 
Changes to the Marketable Record Title Act 
affecting all homeowners associations incoming!

One of the most significant bills to be approved affecting community associations in this last legislative session was Florida House Bill 617, which became Law of Florida 2018-55, effective October 1, 2018. This bill offers an alternative summary procedure by which certain community associations preserve their governing documents pursuant to Florida Statute 712 (the Florida Marketable Record Title Act) and Florida Statute 720 (the Florida Homeowners' Association Act).   This bill also requires all homeowners associations to address the MRTA topic at the first regular Board meeting of each newly-elected Board.

This year's "Pet Supply Drive" was another rousing success! We managed to raise funds and collect donations for the Orange County Animal Shelter's continued effort to ensure the well-being of all of our Furry friends in our local community. Director of Public Relations, Arlene Ring, and Marketing Representative, Nathan Knoebber, are pictured delivering our donations to the wonderful staff at Orange County Animal Services. A Must For Every Association With Or Looking For A Manager
 
This October, we are hosting a unique seminar that we have not seen presented anywhere else. It's our new "Selecting and Working More Effectively with Managers" seminar. This 1½ hour course prepares Board Members in the selection process of a manager. Among the topics covered are:
  • What questions to ask and how to conduct the interview
  • Screening your manager's (or management company's) background
  • Red flags to look out for
  • What a manager can and cannot do for the Association
  • Realistic expectations of your manager
  • Ways to work more effectively with your manager
  • Understanding your manager's role
Our Director of Public Relations, who has worked with numerous management companies and managers over the past 28 years, will host the first part of the program on selecting a manager. The second part of the program will feature Chris Bertoch, manager of Park Lake Towers, for the Maitland Seminar, and Betty Walsh, manager of Seaport Master Association, for the Melbourne seminar. These Managers will be speaking on how to more effectively work with your Community Association manager. Both of these managers are independent managers - not with a management company - and do not service any additional associations in these areas. This avoids any conflict of interest and provides the attendee with the comfort of being able to ask any questions about "Working More Effectively with Managers."

Mobile Home Park (Chapter 723)
Cooperatives (Chapter 719)

Each book features a custom forest green binder with gold inlay. Chapters are tabbed and each page has been placed in a sheet protector. The books include the various Statutes relevant to the particular book's community type plus a bonus of numerous educational and legal information articles on the basics of operating your Community Association.

Governing Document Amendments Service
 
Amending Governing Documents is a fairly common legal activity that Clayton & McCulloh gets asked to do.  Most amendment work is done on an hourly basis for our Association clients, however two of the most frequently requested amendments are the "Quorum Requirement Amendment" to hold meetings and the "Amend the Amendment Provision" Amendment.  We now feature fixed fee rates for preparing amendment packages for these two amendments.  Sometimes the Amendment desired needs to occur with respect to more than one of your Governing Documents.  Our fixed fee for this service is per package and per Document amended (Declaration, Articles of Incorporation, and By-Laws).

Always remember to do your civic duty! The deadline to register to vote for the upcoming midterm election is  October 9, 2018. 

Vote-by-Mail "Send" Deadline
For domestic voters, the mandatory period for election officials to send ballots is between 35 and 28 days before an election. The sending period for the 2018  General Election is October 2 - 9, 2018.

Early Voting
General Election:  October 27 - November 3, 2018
"In addition, each county Supervisor of Elections may offer optional days of early voting in addition to the mandatory early voting period.  Each Supervisor of Elections may choose from one or more of the following days for 2018:  October 22, 23, 24, 25, 26 and/or November 4, 2018"  Check with your  county Supervisor of Elections  for the additional days of early voting that may be offered in your county.
