Survey of Employer Policies on the Employment of People with Disabilities 


The U.S. Department of Labor’s Chief Evaluation Office and Office of Disability Employment Policy published results from their 2018 "Survey of Employer Policies on the Employment of People with Disabilities." The survey provides an overview of employers' efforts to employ people with disabilities and attitudes toward people with disabilities. The 2018 survey builds on evidence established by a 2008 survey and provides nationwide data. Three issue briefs analyzing the data were also released.

Can an ADA Lawsuit be Filed against a US Company
Located outside the US?

Article by Sheri Byrne-Habe r, Head of Accessibility at VMware, member of the IAAP Global Leadership Council. Degrees in CS, law, business, CPACC certified. Wheelchair user with a deaf daughter.

The answer is yes — and here is a case to watch that is going to test that theory, at least in one state.

Remember, this is NOT legal advice. If you find yourself in this situation, you need to consult a US lawyer who specializes in accessibility cases, and a foreign attorney who specializes in enforcing US judgments.

There are three basic phases for every US civil lawsuit, no matter how complicated or what the subject of the lawsuit is about:
  1. Can you file the lawsuit?
  2. Can you win the lawsuit?
  3. If you win, can you collect the damages you have been awarded?

How is the Department of Justice Addressing Website and ICT Accessibility?

In light of the critical role that the Internet and information and communication technology ( ICT ) play in contemporary society, including in the employment context, the federal government recognizes that access to information and electronic technologies is a civil right and a vital employment issue for individuals with disabilities. 
The Department of Justice (DOJ) has  taken the position (link is external)
 that title II (state and local governments) and title III (public accommodations) of the Americans with Disabilities Act (ADA) covers Internet website access, mobile applications, and other forms of ICT.

Resources for People with Disabilities in Emergencies & Disasters


The rights of people with disabilities do not disappear in times of crisis.  While disasters, emergencies, and other crisis scenarios often require sacrifices, the rights and lives of disabled people do not need to be one of them.

Access to resources in disaster is especially important for people with disabilities, who are disproportionately impacted by emergencies and disasters. Here are some resources we recommend for people with disabilities, organizations, and emergency planning and response managers:

Conference Board Research
Recent  research  from The Conference Board found that 9% of surveyed U.S. organizations had conducted permanent layoffs before the end of April as a result of COVID-19. However, more than double that number, 16% of organizations, are planning to conduct permanent layoffs by the end of July.

But algorithms also are used in many more hidden aspects of life too: applying for jobs, handling eligibility for government benefits, making pretrial release decisions, and more.

In this webinar, our presenter will talk about the various ways that A.I. and algorithmic decision-making discriminate against people with disabilities and reinforce ableism. They’ll also discuss the difference between “fairness” and “justice,” and why it’s important for us to talk about disability justice and algorithmic justice rather than algorithmic fairness or disability rights.

TransCen, Inc. and the Mid-Atlantic ADA Center are moving forward with our plans to host the 2020 Mid-Atlantic ADA Conference ( ADAcon ) September 9 -11, 2020 in Alexandria, Virginia. We continue to monitor the  Commonwealth of Virginia’s guidelines  for safe gatherings. For those who are planning to attend this year’s conference, we want to let you know that your safety is our top priority.

  • Our conference staff will follow the recommended guidance for wearing masks, limiting contact and social distancing.
  • We are working closely with the Mark Center Hilton to ensure safety for our participants. Hilton’s corporate office has issued a statement detailing their health and hygiene protocols
  • Conference meeting room set ups have been revised to take into account social distancing and reduced capacities. We, in turn, must limit the number of participants we can accommodate this year.
  • We have been assured by the audio-visual vendor that they have procedures in place for their staff to maintain hygiene and provide clean equipment for all of our conference sessions. 

Safety always comes first, but we also want to provide our participants a quality program with the latest and most reliable information on the Americans with Disabilities Act. Most of our speakers will be presenting in person. We have several speakers, however, who are unable to travel to the conference and will be presenting remotely.

The M-Enabling Summit Conference and Showcase is dedicated to promoting accessible and assistive technology for senior citizens and users of all abilities.

It is an annual meeting place for all who implement digital accessibility strategies or develop enabling ICT products, services for workplaces, learning environments or consumer markets. With its theme of “Digital Inclusion Strategies: A Catalyst for Action”, the 2020 M-Enabling Summit will highlight how organizations can successfully leverage innovative enabling technologies to make their digital workplaces, learning environments and product and services accessible to users of all abilities.

The Hon. Katherine McCary, President, C5 Consulting, LLC serves as CEO and Executive Director. Katherine served as founding chair of the USBLN (now Disability:IN) for nine years, the founding chair of the VA BLN (Now Virginia Ability) for 13 years and has launched more than 11 chapters. She received the USBLN Lifetime Achievement Award in 2009. She recently joined GRACE Global Fund as Director of Inclusion.
