Supreme Court Decision Alters State Sales Tax Rules

The internet has changed our lives in so many ways, and the U.S. Supreme Court just added one more. In the case of “ South Dakota v. Wayfair,” the court ruled for the state of South Dakota, upending years of precedent and paving the way for states to now collect tax revenues from e-commerce retailers.
With the rise of the digital economy, states have lost significant sales tax revenues because they have been unable to impose the collection of sales tax on online sales under the former physical presence standard. Overturning a prior precedent that sided with retailers, the Supreme Court justices voted 5-4 in this landmark decision, ruling that the prior physical presence test created unfair and unjust marketplace distortions favoring remote sellers.

What does this mean to us in Illinois? Beginning October 1, 2018, Illinois law requires a remote seller lacking a physical presence in the state to collect and remit sales taxes if 1) the seller’s gross revenue from sales into the state in the previous calendar year or current calendar year exceeds $100,000, or 2) the seller made at least 200 separate transactions into the state in the preceding 12-month period. This threshold is different depending on the state, so if you’re running an e-commerce business, you’ll need to collect taxes based on each state’s rules (and this may apply to services as well as products in some states). And if you make purchases on the internet, be aware that you may see sales tax now added to your bill.

Our People Make a Difference

The MMA & Co. team enjoyed being a part of the United States Golf Association (USGA) inaugural U.S. Senior Women's Open , held July 12-15 at Wheaton's iconic Chicago Golf Club. Volunteers from our office included Laura O'Malley, Brandon McHugh and Mike and Tori Moyski as well as retired partner Jim Mathieson. Live coverage of the event showed Mike & Tori cheering on the winner of the tournament, Laura Davies.

We were also the proud sponsor of one of the 13 large golf balls painted by local artists and displayed throughout downtown Wheaton, a project of the City of Wheaton Fine and Cultural Arts Commission . Our artist Patricia Melekus joined the other artists, sponsors and a panel of representatives from Chicago Golf, the USGA and two of the golfers at a reception held July 9 at Arrowhead Golf Club, kicking off the week in style. We're proud to have participated in this landmark event.

Speaking of Golf...
Our own women golfers gathered in front of the MMA & Co. ball before heading off to the Carol Stream Chamber of Commerce golf outing. The proceeds of the golf outing, the chamber's largest fund-raiser during the year, go toward a scholarship program. This year the CS Chamber awarded five scholarships of $1,000 each to high school students from Carol Stream.

The Dog Days of Summer
We're in the dog days of summer when time slows down, a time to take a vacation or walk the Prairie Path. While our pace may change during the summer, our MMA & Co. team continues to work, helping clients meet their deadlines all year long. Please let us know if we can be of service to you in any way.

We hope you get the chance to take some well-deserved time off for your own summer pursuits, whether it's camping, fishing, traveling or just sitting outside on a cool evening with family and friends. Enjoy!
