Very soon you will be getting the fall issue of our risk management training catalog, GLIMPSE. It will contain information about each of our workshops and events, about 20 in all, which are available to you free of charge as part of your membership in the CCAP UC Trust, PCoRP, PComp, PIMCC or PELICAN.

Please share the GLIMPSE information with your staff, and point out to them anything you think they would benefit from. If you need more copies of the catalog, let us know. Keep in mind our website also contains details about each event, and you can register right there. We also send out reminder emails a couple of weeks prior to each workshop, tailored to officials and employees who might be interested in the workshop's subject matter.

Keep in mind that in addition to the value of the training received, both PCoRP and PComp have Loss Control Incentive programs which include savings to your county or entity if four or more events are attended each year. So don't miss out on that extra savings!

Opioid Use and Workers' Compensation

According to Business Insurance, the opioid epidemic has had material impact on health care, general liability and workers' compensation lines of insurance. Business Insurance reports that 40 percent of all drug spending under workers' compensation is on opioids!

A recent Liberty Mutual study detailed the problems associated with cases where opioids are prescribed within 15 days following lower back injury. Data showed patients receiving opioids shortly after an injury, when compared to patients who received no early opioids, were:
  • Disabled an average of 69 days longer
  • Three times more likely to need surgery
  • Six times more likely to become dependent on opioids
PComp takes a proactive, evidence-based approach to claim management. We encourage the members to use the first fill program. This limits the amount of any prescription which can be filled to a two week supply. This prompts closer examination when a second opioid prescription is requested.

Using evidenced based practice means, for example, ensuring opioids are only utilized after conservative treatment, and after non-opioid medications have failed, instead of opioid use as an initial pain management option.

PComp partners with CorVel for their pharmacy program. PComp's claim representatives receive an email for every opioid that is prescribed. The PComp claims representative must approve or deny these prescriptions. We are also able to file a utilization review after prolonged opioid use to see if the continued use is reasonable and necessary.

PComp's claims representatives follow all claims closely for opioid use; including watching for multiple claims, co-morbidities, multiple prescribers, multiple pharmacies and by claimants seeking opioids for their own use or as a reason to be off work. We follow all claims, make suggestions for conservative treatment and other ways to manage pain. We utilize early intervention with nurse case management. We've seen that sometimes it takes a face to face with a nurse to open the provider's eyes regarding opioid abuses. We will question claimants and providers when something doesn't make sense. Our claims representatives have years of experience which helps them get a sense of whether something seems odd about the claim. It also helps that we have built strong relationships with providers used by PComp member counties.

What is a Work Related Injury?

We get a lot of questions about something the county is thinking of doing, and whether or not the event would be considered work related, and if an injury occurs, would it be covered by workers' compensation? For example, the county sponsors an exercise class onsite, or has a gym for the corrections officers to use. If an employee is hurt in the class or the gym, those injuries will probably be work related. So would injuries due to training events to which the county sends staff. However, auto accidents on the way to work, for most employees, would not be work related. This does not apply to field staff, who might be going directly from their house to a client's house or another site - injuries there will probably be work related.
 
As you can imagine, there are numerous legal cases on this very issue. Our answer to most of the questions we get is that they probably will be workers' compensation claims, BUT, each injury is on a case-by-case basis and sometimes the workers' compensation judges may rule otherwise. Our advice is always to report it to PComp (or your workers' compensation insurer) and then provide the details needed to help the claims staff determine whether to deny or accept the claim.
 
As with many insurance and risk management questions, often the answer is: It depends!

Fall Risk Management Workshops!

2018 Annual SCHRPP Conference

Drone Updates
Dennis Cutler, Senior Risk Control Specialist

The FederalAviation Administration (FAA) has begun to enforce their drone regulations resulting in significant fines. The FAA is focusing their enforcement efforts in the eastern states for unknown reasons. I would assume they are doing this due to the large concentration of drone use in these highly populated areas.

Listed below is a sampling of citations, along with fines levied.

Washington DC, (G Street and 10th St NW) Shawn Usman, January 26 2015; $5,500
Usman notoriously crashed his drone into a tree on the White House lawn, causing a national conversation on drone safety and White House security. It was later reported that Usman was a government employee at the time and was also allegedly drunk during his flight. The FAA fined him $5,500.

441 East Fordham Road, Bronx NY, Xizmo Media Productions, May 16, 2015; $18,700
Xizmo was hired by Fordham University to shoot footage of its 2015 commencement ceremony. The FAA says that because Xizmo's drone wasn't registered, flew in a reckless manner, and also pulled out several other regulations that are normally used for manned aircraft. Xizmo eventually settled with the FAA for $5,000.

All over Manhattan, SkyPan; $1.9 Million
This is the largest drone fine ever levied. According to the FAA, SkyPan repeatedly flew near high rises in restricted airspace. This case is ongoing.

Coney Island Boardwalk, David Quinones, July 4, 2015; Surrendered Pilot's license
Quinones was hired by a company called Skycam to fly a drone over the Nathan's Famous Hot Dog Eating Contest. Quinones, a commercial pilot of manned aircraft, had his pilot's license suspended for 90 days and was required to surrender his pilot's certificate during the suspension. The FAA said it would fine him $1,100 per day that he refused to surrender it.

There are many flight changes pending, namely flying over people and nighttime operations. However, there is no timetable for their implementation, or even if they will be adopted.

Prison Medical Management Workshop

We are excited for our 10th annual Medical Management Workshop. It is quickly approaching so please mark your calendar for Friday, September 28, 2018 from 8-4 in Harrisburg. Charles Mazzitti of Mazzitti & Sullivan EAP is a confirmed speaker for this workshop. The title of his presentation is "Having the Right Staff is Everything: How to Get Them; How to Keep Them". We also have confirmed Deborah Milito, Pharm. D from Diamond Pharmacy. Her topic is "The Clinical Pearls of Antimicrobial Stewardship". Dr. Paul Noel and Captain Miguel Castro will be presenting on "Gender Dysphoria and How to House the Transgendered Inmate". The last topic will be on Suicide Prevention - QPR gatekeeper training presented by Govan Martin of Prevent Suicide PA. More information will be given on how to register. Grant Programs

Did you know that some of CCAP's insurance programs have grant programs that are offered to program members? CCAP's PCoRP, PComp and PELICAN programs offer grants to their members. In addition to other member benefits, these three insurance boards set aside funds for the grant programs to provide members with financial support to fund loss prevention projects. There are many projects that members have completed using the grant programs. To take advantage of the grant programs, please contact Keith Wentz.

McKean County took advantage of the PCoRP Grant to repair existing walkways, patio areas and to provide a safe pedestrian walkway going to other buildings on campus.
