 If we accommodate an hourly employee under the FMLA who needs frequent 15 minute breaks, are we required to pay for those breaks?

As you may already be aware, breaks of less than 20 minutes must be compensated under the Fair Labor Standards Act (FLSA), because the DOL states those breaks predominantly benefit the employer. So, what is an employer to do when part of accommodating an employee's serious health condition under the Family & Medical Leave Act (FMLA) means complying with the physician's opinion that an employee needs more frequent 15 minute breaks? Does the employer have to compensate the employee for those extra breaks? In short, no. Those extra breaks are for the benefit of the employee and the time off may be deducted from pay or paid time off balances. If, however, your company allows other employees paid breaks, those same breaks should be paid for employees who require more frequent breaks under the FMLA. Read the Department of Labor's  opinion letter .
