New Executive Orders
On June 6, Governor Cuomo signed Executive Order 202.38. This EO includes language granting business operators  discretion to require individuals to undergo temperature checks prior to admittance, and to deny admittance to people who refuse temperature checks or exceed the temperature permitted by NYS DOH guidelines.

The EO also includes the allowance for restaurants or bars to serve patrons food and beverages on-premises in outdoor spaces and allow for houses of worship to begin to congregate at no grater than 25% indoor capacity. 

Executive Order 202.39, issued June 7, amends the prior order to clarify that outdoor food and beverage service is only permitted in Phase 2 regions. The order also extends prior orders modifying education law through July 7, and permits local governments in Phase Two regions to bring non-essential employees back to work beginning two weeks after such regions meet the metrics to reopen.

Incident Management Unit Update
The Office for People with Developmental Disabilities (OPWDD) Incident Management Unit (IMU) advised that they will resume routine follow up activities related to the completion/closure of incidents beginning June 19. The focus of IMU will be sending reminders to Chapters with overdue investigations or corrective action plans and any needed revisions to those documents.
