What are Qui Tam
or "Whistleblower" Lawsuits?
Qui Tam, or “Whistleblower” lawsuits, have made headlines in our national media for decades. These are legal actions brought by private individuals against another person or an organization suspected of defrauding the U.S. government.

If someone has confidential information about a company who is cheating the state or federal government out of money, they may be entitled to a portion of the amount recovered.

Navigating the complexities of a Qui Tam lawsuit requires a delicate balance. Taking such action often results in retaliatory conduct by the wrongdoer, who may be the whistleblowers' current or former employer. Although there are laws and protections in place, those who come forward need to be careful and ensure they are protected. Qui Tam legal actions are best handled by lawyers with the experience, resources, and reputation necessary to protect the whistle blower and secure a verdict. 

David TeSelle is a shareholder and the Co-Practice Group Leader for Burg Simpson's Commercial Litigation Team. Mr. TeSelle has successfully tried numerous cases to jury verdicts in both state and federal court, as well as private arbitration. He has successfully battled the largest banks in the world, including in litigation related to the 2008 economic collapse (the "Big Short" cases). In 2019, he was lead counsel on one of the largest personal injury jury verdicts in Arizona history ($58.5 million). Mr. TeSelle regularly represents numerous plaintiffs in class action and mass tort actions against corporate bad actors and focuses his thriving practice on complex trial litigation.

David P. Hersh:
Serving to Promote Lawyer Well-Being
Shareholder and Co-Practice Group Leader of the Commercial Litigation Team, David P. Hersh is currently serving on two committees that focus on lawyer well-being. He was appointed by associate Justice Monica Marquez to serve on the Colorado Supreme Court Task Force for Lawyer Well-being. He also chairs the wellness committee for the Arapahoe County Bar Association.

These committees were created to assist lawyers who have problems related to substance abuse and addiction, mental health issues such as depression and anxiety, and work/life balance issues. Committee members are available to assist lawyers with finding resources available to them (such as COLAP – the Colorado Lawyer Assistance Program http://coloradolap.org/ ) and further the public dialogue about these issues to “destigmatize” them. It is the goal of these committees to bring awareness to the entire legal community about the importance of maintaining a balanced and healthy lifestyle. 

David Hersh offers his time (as well as his experience, strength, and hope) on these committees because he knows just how difficult it can be to practice law and deal with well-being issues.  Dave is well-known for his commitment to staying healthy and fit, an essential component for many lawyers seeking well-being. He is famous (some would say notorious) among his colleagues for his century bicycle rides to support various charitable organizations. Dave has often led Burg Simpson’s Pedal for Possible team, the annual bike ride to benefit Craig Rehabilitation Hospital, and specifically those with spinal cord injuries and traumatic brain injuries. 
RONDA KELSO
CHANGING LIVES AS A LAWYER AND A NURSE
Burg Simpson attorney Ronda Kelso, who also maintains an active nurse’s license, recently spent time in Kenya as a medical volunteer.

Ronda accepted an invitation from a former colleague at Children’s Hospital in Phoenix to join a mission with Covenant Medicine Outreach (CMO) and volunteer in a makeshift rural clinic just a few hours north of Nairobi.

While working with CMO, Ronda and her team treated over 900 patients, bringing medical care, support, and compassion. Of her time in East Africa, Ronda said, “ It was a privilege to have experienced such a journey and an honor to have touched the lives of so many.”

Prior to becoming a trial lawyer, Ronda Kelso worked as a certified pediatric nurse. She entered the legal field after working as a nurse consultant to hospitals, physicians, and individual clients and families regarding medical malpractice claims.
Ms. Kelso's experience has proven invaluable while working closely with clients at Burg Simpson who have experienced injuries as a result of medical negligence.
