Summary Judgement in 
Arbitration of Debt Collection Claim

Claimant took out a personal loan from Prosper Marketplace, Inc.; she became late on the payments and Prosper began attempting to collect the debt.   Claimant sent Prosper a letter stating that she was unable to pay the debt and requested that the collection calls cease; however, the letter was sent to an address designed only for the receipt of payments that was not monitored by employees of Prosper; therefore, it did not receive actual notice of the request to stop collecting the account. Claimant contended that Prosper harassed her by collecting the account after she had mailed the letter.  Claimant further contended that Prosper violated the federal TCP by making automated dialer calls to her cell phone without permission; and a number of other derivative claims.
 
The arbitrator, a former Circuit Court judge, granting summary judgment on all allegations of misconduct based upon Claimant's failure to provide evidence to support her claims in opposition to evidence produced by Prosper that it was unaware of the contends of her letter; that all calls to collect the debt were made by representatives and not an machine; and, that Claimant failed to present evidence of any intent to harass her in the collection of the debt.    The arbitrator relied upon the Supreme Court's decision earlier this year in Lenahan v. Valentine & Kebartas; my case as well; wherein the Court held that collection calls alone is not sufficient evidence of an intent to harass under the Consumer Credit Protection Act.

Suleiman O. Oko-ogua is a Member in Bailey & Wyant,  PLLC's Charleston office. 
Suleiman O. Oko-ogua is an Associate in Bailey & Wyant, PLLC's Charleston Office.  Suleiman is originally from Nigeria, West Africa and moved to the United States in 1997 to attend College. He graduated from Berea College in 2001, with a Bachelor of Arts Degree in Biology. He then graduated from the University of Kentucky College of Law in 2004. While in law school, he was a Senior Staff Member of the Kentucky Journal of Equine, Agriculture and Natural Resources (formerly Journal of Natural Resources and Environmental Law).

Prior to joining Bailey & Wyant, Suleiman clerked for a Kentucky State Judge. He also spent about three years as a prosecutor and as a private attorney in Kentucky. As a prosecutor, he prosecuted criminal, abuse, neglect and child support cases on behalf of the Commonwealth of Kentucky. As a private attorney, he was involved in custody, personal injury, civil rights and employment law cases. Recently, Suleiman was associated with a defense firm in Huntington, West Virginia, where he defended major railroad companies in various tort actions. He also defended several large medical device companies in products liability cases and a regional restaurant chain in premises liability cases.

As a Member at Bailey & Wyant, Suleiman practices in the areas of civil litigation, most notably civil rights litigation, employment law and insurance defense as well as bodily personal injury arising from premises liability claims and other similar claims. Notably, Suleiman has successfully defended various government agencies and employees in various civil rights and employment law cases filed against them. Suleiman was named to Lawyers of Color's 2014 Annual Hot List and voted among top the 100 National Black Lawyers. He is a 2017 Fellow for the Leadership Council on Legal Diversity.
