Leave a Legacy resources are in!

The 2017 Partner Booklets are printed and available.  If you have not already received copies or need more, they will be available at the upcoming mixer and networking lunches.  We encourage you to attend these events to broaden your relationships with your fellow Leave a Legacy members as well as increase your knowledge in the area of planned giving.  Should you need copies of the booklets ahead of these events, please feel free to contact Kendall and arrange a time to stop by the York Bar Association to pick some up.

Also in are the Leave More Than Footprints door mats.  You likely remember the large yellow dot stickers we placed in front of our establishments last fall.  Well, they were so well received, we decided to make reusable, portable versions.  If you have an upcoming event and want to establish a talking point at your entrance or another strategic place in the room, please contact Kendall to borrow one, two, or all three!

Starting in October, the Marketing Committee will also be sending out monthly planned giving suggestions.  These e-blasts will include everything you need to execute a consistent and effective planned giving strategy.

We are seeking additional planned giving questions from our nonprofit members.  Within each newsletter, one of these questions will be answered by a professional advisor partner.  Please direct your questions to Kendall Menzer, kendall.menzer@yorkbar.com, and/or Jen Hitz, jhitz@legupfarm.org.

What is the best way to handle farm and/or property bequests?

After receiving notice that your organization has been named a beneficiary of an estate, be sure to follow up with the attorney for the estate and request a copy of the will or trust. Real estate bequests can often be the trickiest bequests for an organization to handle. When the bequest is a farm, additional unique concerns may arise.  For example, farmland may involve environmental concerns. Many farms have or once had underground storage tanks for fuel. In order to avoid any liability for environmental issues, it is essential for beneficiaries of farm bequests to investigate the presence or absence of these tanks, as well as how the prior owner kept and stored other chemicals, like pesticides, on the property. Hiring someone to perform a phase one environmental audit of the property is a step in the right direction.

Your nonprofit should hire an attorney to perform a 60-year title search on the real estate. The title search can provide your organization with valuable information to help make your decision to accept or disclaim the bequest. First, the title search will allow your nonprofit to determine if there are any liens, judgments, or mortgages on the property that could cause difficulties down the road.  Second, you will discover whether a conservation easement was placed on the farm. This agricultural preservation easement affects how your organization can use the property. The title search will also disclose whether the farm was enrolled in the Clean and Green Preferential Tax program. "Clean and Green" offers farm owners significant tax savings, but it restricts the ability to subdivide and sell the land. It is crucial for your organization to determine if the devised property was enrolled in the program because there could be huge tax consequences if program rules are violated.

Another issue to consider is whether there are any written or oral hunting agreements on the property that could affect your use of the land. Further, did the estate or decedent lease out the crop land for others to farm and harvest? It would be wise to obtain copies of any such agreements before moving forward with the bequest. Remember, every estate and situation is different, so be sure to contact your own counsel when you are the beneficiary of a farm.

1. Leg Up Farm : We are excited to host the 5th Annual First Capital Federal Credit Union Fall Fest on October 14th from 10am - 3pm. Fall Fest features 60 craft and 15 food vendors, kids' activities (including pumpkin decorating and a trick-or-treat trail) silent auction, equine demonstrations and more. 3. York County History Center: We are looking for volunteers to assist with our annual History on the Half-Shell (formerly Oyster Festival). More information here!

6. Christian School of York: You are invited to the annual Veterans' Day program at the school on Wednesday, November 8, beginning at 1:00pm. For one hour we will honor our veterans and active duty military personnel through songs, spoken word, and dramatic presentations. Light refreshments will be served at the conclusion of the program. 7. Horn Farm Center: Everyone is invited to our free Harvest Festival at the farm! Wednesday, October 11, from 5:30 to 8:30. Food and friends from 5:30-6:30, a program with board president and executive director sharing accomplishments from 6:30 - 7:00 and then tours of the farm!

8. York County Bar Foundation: Community Summit - SAVE THE DATE - October 24, 2017 at the Wyndham Garden in York! This second Community Summit will highlight law-related programs available locally to increase access to justice as well as seek to encourage collaboration between legal services and social services to better meet the needs of our community.

9. The Salvation Army: Fall is "Kettle season" for The Salvation Army and they would love Kettle volunteers. If you are interested, please contact Roxie Brought at 717-848-2364 x 219.
