New I-9 Form

The Office of Management and Budget (OMB) and U.S. Citizenship and Immigration Services (USCIS) recently announced a new I-9 Form effective September 18, 2017.  The key points are:
 
  • USCIS released a revised version of Form I-9, Employment Eligibility Verification, on July 17.
  • Download instructions are available on the Form I-9 page.
  • Starting September 18, 2017, employers must use the revised form with a revision date of 07/17/17 N.
  • Employers must continue following existing storage and retention rules for any previously completed Form I-9. 
 
Federal Agencies Significantly Increase Fines For I-9.
 
The U.S. Departments of Justice (DOJ), Homeland Security(DHS) and Labor (DOL) announced higher civil fines against employers who commit immigration-related offenses, including Form I-9 and E-Verify violations, the unlawful employment of foreign nationals, unfair immigration employment practices and H-1B and H-2B program violations.
 
I-9 Penalties Are As Follows: 
 
Monetary penalties for knowingly hiring and continuing to employ violations range from $375 to $16,000 per violation, with repeat offenders receiving penalties, at the higher end. Penalties for substantive violations, which includes failing to produce a Form I-9, range from $110 to $1,100 per violation.
 
Other I-9 Key Points.

It is important to note that the new I-9 Form is NOT an electronic I-9 Form, as employers are still required to fill out the new form using Adobe Reader.  They also will be required to print the form, obtain handwritten signatures, store their I-9 Form in a safe place, and retype information into the E-Verify system.
