One-on-One with IACP President Baylor Rice

Thank you for the opportunity to talk with you about IACP fundraising efforts! In my last  One-on-One with you, I shared our current IACP  Member Initiatives , how you can contribute to IACP, IACP Foundation and COMP PAC, and what the mission and activities are for each area. Thanks for all the feedback on this article! I'm pleased it helped to clarify our fundraising goals and objectives, and answered some of your questions on our efforts.

Stay tuned next week for another One-on-One which will provide you details on how your dues and contributions are being employed. It's vitally important to the IACP Board of Directors that we operate in a fully transparent manner, providing you with information on how your dues and contributions are being put to work. The IACP Board and Staff are working tirelessly to ensure that we are strategically applying your contributions to our ongoing efforts, while also being vigilant on where we can be more efficient and save money. Next week, I will provide you with a detailed accounting of our expenses and where we are applying your contributions. Article Excerpt: "Addressing Food & Drug Administration (FDA) Guidance Documents and concerns that FDA has issued no rules for compounding but only guidance documents, which aren't legally enforceable, IACP Executive Vice President Cynthia Blankenship says, 'Mass confusion has resulted from the usage of guidance documents, and the FDA is definitely circumventing the Administrative Procedure Act (APA) in our opinion,' The APA governs how federal agencies propose and establish regulations. IACP wants Congress to pass a bill (H.R. 2871) they say will fix these issues."

  • UnitedHealth Group's health insurance and PBM units have teamed up with Allscripts to offer PreCheck MyScript, giving real-time patient-specific information on drug pricing at point of care. Insiders say United's move is innovative and could launch a new trend in such capabilities if the venture goes well.
  • UnitedHealthcare and OptumRx say the product will give physicians what they have wanted for a long time: to help their patients, and thus health plans, save money. The insurer contends it is the first to offer the tool, which is now available to all care providers in its network. OptumRx will offer PreCheck MyScript to additional clients in early 2018, the companies said.
  • Throughout the past year, and without much fanfare, Amazon.com Inc. has gained approval to become a wholesale distributor from a number of state pharmaceutical boards according to a review of public records.

IACP Board Member Anthony Grzib, RPh , IACP Members Marcy Bliss and Randy Burrows , Wedgewood Pharmacy in Swedesboro, N.J., hosted Congressman Buddy Carter (GA) as he toured the pharmacy's state-of-the art facilities and discussed the unique role compounding plays in veterinary medicine, and the Congressional intent that it remain a state-licensed practice. IACP Member Michael Blaire, RPh, FIACP , Diamondback Drugs in Scottsdale, Ariz., met with Congressman Scott Taylor (VA) , the only freshman Congressman to be appointed to the House Appropriations committee.

  •  FDA Commissioner Gottlieb Grants DQSA Coalition Meeting Request - IACP Members : We have some very exciting news! Due to the incredible diligence and hard work of the DQSA Coalition , the Food & Drug Administration (FDA) Commissioner, Scott Gottlieb, MD , has granted our request for a meeting. Read here Dr. Gottlieb's letter sent to David Pore of Hance Scarborough LLP , IACP's D.C. legislative counsel. 
The DQSA Coalition, comprised of more than 30 provider and pharmacy organizations and led by  IACP's Executive Vice President Cynthia Blankenship , was created with a primary goal of ensuring the FDA implements the  Drug Quality & Security Act as Congress fully intended in order to preserve patient access to vital compounded medications.  As such, the DQSA Coalition has steadily worked over the past year to communicate its concerns that patients are being prevented critical access to the essential compounded medications upon which they depend. Please click here to view the letter the DQSA Coalition sent last June to the United States Secretary of Health and Human Services Dr. Thomas E. Price, requesting a meeting to discuss these concerns on behalf of your patients. We are pleased our efforts have resulted in scheduling a meeting with Dr. Gottlieb and will keep you apprised of all updates. IACP is working hard to preserve your patients' access to life-saving compounded medications!
  • The Food & Drug Administration (FDA) announced on October 25th that a Pharmacy Compounding Advisory Committee (PCAC) meeting would occur on November 20-21, 2017 during the week of the Thanksgiving holiday. PLEASE NOTE: The PCAC meeting will be open to the public, and you are encouraged to submit comments and attend the meeting.
The meeting will be held from 8:30 am to 5:00 pm on Monday, November 20th, and from 8:30 am to 11:30 am on Tuesday, November 21st at the FDA White Oak Campus, 10903 New Hampshire Ave., Bldg. 31 Conference Center, the Great Room (Rm. 1503), Silver Spring, MD 20993-0002. In the Agenda portion of the notice, the FDA announced that the nominators of the following substances and products will be invited to make a short presentation supporting the nomination: astragalus, L-citrulline, pregnenolone, 7-keto dehydroepiandrosterone (DHEA), epigallocatechin gallate (EGCg), and resveratrol.   • FDA Releases PCAC Briefing Documents Ahead of November 20-21 Meeting Detailing FDA's Recommendations on API & Compound Nominations - The November 20-21, 2017 Pharmacy Compounding Advisory Committee (PCAC) meeting briefing document has been uploaded to the FDA website. In addition, FDA has made updates to the PCAC meeting agenda and public participation details which can be found here. More information in this IACP Member Alert
  • DQSA Coalition Update - New Messaging Documents coming soon! The DQSA Coalition has developed a Steering Committee that is working diligently on new messaging documents as well as additional Congressional efforts. Stay tuned for the release of these documents soon!  
  • Your Efforts are Making a HUGE Difference! We Now Have 40 HR 2871 Cosponsors! Has Your Representative Signed On? Please send a direct communication to your Member of Congress. HR 2871 will help clarify the Drug Quality & Security Act (DQSA) in a way that will better align the statute with congressional intent and most importantly, better balance public safety and patient access. 
  • Continue to collect patients' stories and let us know if a patient would like to get involved! We need patient stories for our Congressional documents as well as any potential future hearing.  Please let us know if you are willing to be the voice of your patients or whether you know of patients willing to provide quotes or speak on the record!
Congress and Agency Actions in the News

Politico - Pulse - Senate Democrats Issue 'Requirements' for Next HHS Secretary
  • In a joint letter to the White House, Sens. Patty Murray and Ron Wyden - the ranking members on the Senate HELP and Finance committees, respectively - petition President Donald Trump on how to pick the next leader of HHS.
  • "In light of the concerning trend of extreme, ideological policymaking at [HHS] and the serious ethical concerns resulting in former Secretary Price's resignation, we write to outline priorities by which to evaluate any nominee for Secretary of HHS," the two senators write, before listing off 51 requirements that they say the next appointee must meet.
  • But some of those priorities set up political conflicts. For instance, the Democrats want the next secretary to "protect and improve the Medicaid program" and "support access to all approved methods of contraception at no out-of-pocket cost" - policies that many Republicans just don't support.
  • Murray and Wyden also want the next secretary to "be a careful steward of taxpayer dollars, including adhering to federal travel regulations [and] the HHS Travel Policy Manual." 
State Advocacy
  • Important Notice from the Ohio State Board of Pharmacy - Due to reports of critical drug shortages, the State of Ohio Board of Pharmacy has postponed the rescission of pharmacy compounding rules 4729-16-10 and 4729-16-07 of the Ohio Administrative Code to a date to be determined later. Read more here.
  • Massachusetts State Board of Pharmacy Notice of Public Hearing - Notice is hereby given pursuant to M.G.L. c. 30A, § 2, that the Board of Registration in Pharmacy (Board) within the Department of Public Health (Department), will hold a public hearing on the Board's proposed new regulation at 247 CMR 17.00, Sterile Compounding. The proposed regulation sets standards for sterile compounding practice, as mandated by M.G.L. c. 112, § 39G. The public hearing will be held on Monday, November 13, 2017, at 10:00 am in Room 417A/B (4th Floor), 239 Causeway Street, Boston, Massachusetts 02114. Hearing testimony may be presented orally or in writing; a written copy of any oral testimony will be requested. More information including written testimony submission instructions here. IACP plans to provide written testimony for this hearing. 
  • NOW AVAILABLE! State-by-State Analysis of Office-Use Compounding Regulations! Your Government Affairs team just released a State-by-State Analysis of Office-Use Regulations! We researched State regulations, State notices, State activity, and called State Boards of Pharmacy when regulations conflicted with actions to determine each State's office-use actions. In the instance where a State had recently changed its office-use practices, we called to determine why, and the response was noted when FDA had communicated that State law was pre-empted with Federal law.
You will find two documents - (1) the State-by-State analysis and (2) a complete supplemental document where all State regulations and actions are housed. The State-by-State analysis is a quick reference guide that demonstrates State regulations and current thinking on office-use and all supporting documents to this research can be found in the supplemental document. The DQSA Coalition intends to use this document to see whether model office-use State laws exist, to educate and assist States that are attempting to change office-use practices on the intent of Congress, and to focus on specific states for the State Board of Pharmacy/Board of Medicine Coalition Letter that is coming soon!

  • USP General Chapter <800> State Adoption Status Chart. NASPA has developed a chart providing each state's current adoption status of USP's General Chapter <800>. Thank you, IACP Affiliate NASPA, for developing this invaluable tool!
