PRESIDENT ELECT

I'm an Oklahoma native and a 2003 University of Oklahoma Architecture graduate.  After spending five years in Kansas City, my wife Erin and I moved back to Oklahoma.  In 2008, I struck out on my own and started Spur Design.  After seven fast-paced years, we now have three great kids, Elizabeth, Vivian and Hank and a great group of staff here in Oklahoma City and Kansas City.

DIRECTOR
Chris Nuttle, AIA of Guernsey
Grew up in Blackwell.  Went to college at OSU (Go Pokes!).  Ran track for a year at OSU (wow that was a long time and 20 pounds ago).  Spent a year of exchange in Belgium in a city called Louvain-La-Neuve. (A very interesting town.  Basically a college town built from scratch, and designed for pedestrians.  The center of town isn't even accessible by automobile, except for underground parking.)  Out of school I worked in OKC for 2 years, then San Diego for 6 years, and now back in OKC for close to 7 years.  I really enjoy putting on my headphones, and walking urban areas to experience the energy that the architecture and city planning create.  I am also passionate about the arts and education.

I'm confused! Who am I? What title can I use? Is it legal? Who says so?

By: Jean Williams, Executive Director, Oklahoma Licensed Architects, Landscape Architects & Interior Designers

I have been asked by Melissa Hunt, Hon. AIA Executive Director to explain and try to clarify the acceptable and proper titles assigned to people pursuing their education, training and testing for licensing purposes.  You are not alone in asking these questions.  Here is the low down......

The American Institute of Architects, known as AIA is currently wrestling with the topic of titles architectural candidates or applicants are able to use.  As of this writing, they have decided to use "Associate Architect".  That is fine for them to determine you are able to use the title, however it is illegal. "Why", you ask?  Because it is against the State Architectural and Registered Interior Designers Act, which is your only authority. They have no legal authority to tell those in or pursuing the profession of architecture what they are able to use or not.  This organization is a professional organization made up of practicing architects, their firms and associates.  It is voluntary to belong to this group and has no authority to issue your license, maintain its status or define legal terminology.  They promote the profession and educate the public on the value of the profession as it applies to their health, safety and welfare.

The National Council of Architectural Registration Boards, known as NCARB is an organization whose voting membership is the state boards, territories and provinces.  This organization was established to develop methods to ease reciprocal licensing among the states and transfer records in support of applications.  It has now grown to write the examinations through volunteer licenses, keep records on persons applying to take the examinations by tracking the completion of all examinations, experience and education for licensure.  It also transfers electronic records to support initial licensing and reciprocal licensing.  Currently it is establishing agreements for international reciprocities from country to country.   NCARB had a committee that studied this title topic a few years back for the purpose of including the title in their Model Act and Rules.  A resolution was presented to the Annual Meeting, voted on and passed which enables the inclusion of the title in the Model Act and Rules and published.  Later, another committee thought the subject needed further clarification, so it was sent to another NCARB Committee to study again.  This time, when it came out, the recommendation was to eliminate the term "Intern Architect" or variations of this name.  This was due to the fact that the state licensing board's laws prohibit the terms "Architect" or any derivation of the term for usage other than licensed professionals.  This was again sent to the Annual Meeting and the term "Intern Architect" was removed from the Model Act and Rules by a passing majority vote of states present.  NCARB is out of the title business now concerning persons completing the requirements for licensing, which I will call Architectural Interns.

A Model Act and Rules are just that ... a model the state licensing boards can use to develop each state's statutory requirements and rules to say how all is to be applied in the real world.  Models are wonderful tools to use, however, each state has a Legislature, elected by the people of that state that has their own ideas of what is or is not acceptable.   The Legislature presents their ideas and develops legislation known as a bill.   The bill is then sent to committees in each house and if it passes the committees, is sent to the floor for action, then on to the opposition house of the Legislature for the same processes there.  Once passed by both the House of Representatives and the Senate, is it then delivered to the Governor who either signs it into law or vetoes the bill.  If the Governor signs the legislation, it becomes law.  If a Governor vetoes the legislation it is sent back to the Legislature.  There, the Legislature has the authority to try and override the Governor's veto and make the legislation law.   If unable to do this, the legislation dies and has no effect. If successful, it becomes law.  The state licensing agency develops rules that basically go through the legislative processes much like a law.  The Governor then signs the rules or vetoes them.  If the rules are signed, then they also have the same effect as law and are enforceable through the courts.

So, what does all this legislative information on passing laws have to do with what title is given to a person pursuing architecture?  Everything.  The only entity that has statutory jurisdiction over titles people use in architecture is the Board of Governors of the Licensed Architects, Landscape Architects and Registered Interior Designers of Oklahoma, known as the state board (agency) governing architecture and only within the boundaries of Oklahoma. It is the legislative process.  Other state boards have jurisdiction within their own state, so you have differing requirements state to state and presumed all are legal.  They are the state agency that is given responsibility for implementing and enforcing the requirements of the law.  This is due to the fact most state licensing agencies (board) have a title and practice act, meaning how you practice and titles you use are determined by the Act and Rules of the jurisdiction of the state licensing board and no other entities.  Currently, our Rules allow you to use "Intern Architect" or "Architect Intern" and it is legal if you qualify under the definition in our Rules.  Other topics of interest can be found in these documents.  The current versions of the Act and Rules are on our website www.ok.gov/architects.  Make this website your authority as to what you can and can't do.  If you have questions on any topic within the Board's jurisdiction, please give us a call at 405-949-2383 or email:  Ellen.White@boardofarch.ok.gov; Leslie.Hanska@boardofarch.ok.gov; or Jean.Williams@boardofarch.ok.gov.
