SWEETENED BEVERAGE TAX

Beginning today (August 2nd), Cook County has put into effect the Sweetened Beverage Tax (SBT). Retailers must begin collecting the tax today, Wednesday, August 2nd.

Who Pays the Tax?
The ultimate incidence of and liability for payment of the sweetened beverage tax is to be borne by the purchaser of the sweetened beverage. Any distributor of bottled sweetened beverages and any distributor of syrup and/or powder used to produce a sweetened beverage shall collect the sweetened beverage tax from any retailer to whom the sale of bottled sweetened beverages or syrup and/or powder used to produce a sweetened beverage is made and shall remit the tax to the Department of Revenue (Department).

The Distributor or Retailer must include the tax in the sale price of the sweetened beverages, syrup and/or powder.

Should a Retailer obtain product where the tax is due and was not previously paid to a Distributor, that Retailer is responsible for remitting the tax to the Department.

SIGN ORDINANCE

BUSINESS OWNERS: There have been inspectors from the Department of Buildings visiting businesses for enforcement of the sign ordinance.

Here is what they are looking for:
Notwithstanding the provisions of this section to the contrary, a sign permit is not required to erect, maintain, install, alter, repair or enlarge an on-premise sign that is: (i) constructed wholly from paper, vinyl, film or stickers and attached to a window for no more than 60 days; or (ii) painted directly onto the window; provided that signs are not applied to more than 25% of any single window.  Lettering that is painted directly onto the glass of a window and less than 2 inches in height will not be counted in the calculation of the 25% if it is an on-premises sign.  The signs authorized by this subsection (d) shall be counted in the calculation of the total sign area restrictions imposed by section 17-12-1003.

Your storefront window cannot have signs covering over 25% of your window.

Also, please make sure your exit doors are lit and there is proper hardware installed on your door. https://chicagocode.org/13-160-260/

We will continue to update you on additional information as it becomes available.  The Commissioner of Buildings has responded to our outreach and is willing to work with each business to keep them in compliant.  If you received a citation, please email [email protected] so we can help you through the process.
