HOMEOWNERS BILL OF RIGHTS LEGISLATION INTRODUCED IN SENATE

Last week, the two bills that make up the "Homeowners Bill of Rights" package were officially introduced in the Senate. The bills, Senate Bill 387 and Senate Bill 388, make a number of changes regarding local government authority over land use decisions.

Specifically, the legislation impacts local authority relating to substandard lots, conditional use permits, variances, eminent domain, and other zoning regulations. WCA opposes Senate Bill 387 and is monitoring Senate Bill 388.

PUBLIC HEARING ON DHS RULE ON DRUG TESTING FSET PARTICIPANTS  

The Department of Health Services (DHS) proposes an order to create Chapter DHS 38, administrative rules relating to drug testing for participants in the FoodShare Employment and Training Program who are able-bodied adults. WCA has concerns with the promulgation of this rule, including:
  • The cost of drug screening and testing being placed on local income maintenance consortia.
  • The cost of substance abuse treatment being placed on county human services departments. The proposed rule indicates that DHS is the payer of last resort, and the fiscal note prepared as part of the rules process indicates that approximately $356,200 in treatment costs would be funded by county human services agencies.
The public hearing will be held as follows:

Monday, August 21, 2017, 10:00 a.m. at the Brown County Library - Central Library, Auditorium, 515 Pine Street, Green Bay.

Counties have until August 28, 2017 to comment on the rule. Comments may be submitted to the Department by:
1.    Completing and submitting a Public Comment Form to the Department Contact indicated for this rule at: Permanent Rules.
2.     Submitting a comment through the Wisconsin State Legislature's website.
3.    Mailing written comments to: Wisconsin Medicaid Program, Wisconsin Department of Health Services 1 W. Wilson St., Madison, WI 53703

All counties are highly encouraged to submit comments on the rule or appear at the public hearing.

- complex rehabilitation technology for complex needs patients in the Medical Assistance program and requiring the exercise of rule-making authority. WCA is monitoring this bill.
