Legislative Update

There are only 9 legislative days left, although these are spread out over a four-week period, so there is plenty of time for negotiations. That's a good thing because there is still no agreement on pension reform, the budget and taxes.

The Public Protection Cabinet's overhaul of State Boards and Commissions passed out of the House Licensing and Occupations Committee last Wednesday. The committee substitute to House Bill 465 contains an amendment that requires the Governor to pick two of the architect members of the Board of Architects from a list of at least three names submitted by the Kentucky Society of Architects. This makes our law consistent with the Engineers and is a change AIA Kentucky has sought for a long time.

The bill leaves all current boards intact with the same membership they have now. The major changes standardize board procedures, require periodic reviews of board operations and increase the oversight authority of the Public Protection Cabinet.

AIA Kentucky remains opposed to HB 227 which would sharply curtail Kentucky's net metering program and make solar power less attractive. The bill passed the house last week on a narrow 49-45 vote and could possibly be heard in Senate Natural Resources on Wednesday. Members are urged to call their State Representative and urge them to vote no on HB 227.

SB 2 remains in the State and Local Government Committee and is likely dead for the session. The bill would allow for the creation of a uniform statute of limitations and a statute of repose. AIA Kentucky has long favored a statute of repose for design professionals as a means of creating certainty in Kentucky's tort system.

Create new sections of KRS Chapter 12 to define terms; set forth requirements for all occupational licensing regulations established by an agency on or after November 15, 2018; require each agency to conduct a comprehensive review of all occupational licensing regulations under its jurisdiction every five years and to prepare and submit a report of its review to the Legislative Research Commission; establish a process to petition an agency to repeal or modify an occupational licensing regulation; allow a petitioner to appeal an agency's actions or inaction to Circuit Court.

Legislation which would require each public school in the state to employ at least one mental health professional for every 1,500 students, was unanimously passed by the House Standing Committee on Appropriations and Revenue on Tuesday.

Senate President Robert Stivers acknowledged Wednesday that there's little hope that the 2018 General Assembly will pass the pension reform bill.

Legislation to prohibit marriage between an adult and a child under the age of 18 came closer to becoming law on Wednesday.

A bill to ensure safe disposal of opioid drugs that a Republican senator said was delayed in retaliation for her refusal to vote for the controversial public pension bill quickly passed out of a Senate committee Wednesday and passed the full Senate later that same day on a vote of 34-2.

Gov. Matt Bevin ignited fresh outrage among Kentucky teachers Wednesday after he delivered a tongue-lashing to them for opposing Republican efforts to cut their retirement benefits, stupefying some of his GOP colleagues who called the remarks "inappropriate."

A bill which would have proposed a constitutional amendment limiting incoming members of the General Assembly to 16 years failed to muster enough votes to pass in committee on Monday.

A bill which would have required all Kentucky voters to present a government issued photo ID in order to vote failed to pass a House committee on Monday.

The Legislative Research Commission refuses to release documents related to a sexual harassment complaint filed in 2015 against state Rep. Jim Stewart III.

The Work Ready Kentucky Scholarship program has been effective in allowing Kentuckians to learn useful job skills to build a career, and a bill Thursday to continue funding for that program was unanimously passed by the Senate Standing Committee on Education.
