RFP DEADLINES

The Department of Technology of the City and County of San Francisco has issued a Request for Qualifications (RFQ) to pre-qualify firms to submit proposals pursuant to a subsequent RFP to design, build, finance, operate and maintain a citywide fiber to the premises network, lit fiber and Wi-Fi services project. RFQs are due at Noon PT on March 26, 2018.

INCOMPAS Files in Support of FCC's Draft Wireless Infrastructure Order

In an ex parte notice filed last week, INCOMPAS expressed its support for the FCC's draft Wireless Infrastructure Streamlinging Order, which is on the agenda for the FCC's open meeting on March 22. The order is designed to provide a balanced approach in protecting and preserving cultural and historic interests of Tribal Nations, while modernizing the application of NHPA and NEPA rules to prevent unnecessary costs and delays in the deployment of next-generation wireless networks.

INCOMPAS noted in its ex parte that "[e]nsuring that federal historic preservation and environmental review rules (which were designed for much larger structures) no longer apply to small cell deployments, streamlining the rules that will continue to apply to larger facilities, and clarifying when associated fees may be appropriate, are significant steps in fostering the deployment of 5G networks and bringing broadband to more Americans. The application of outdated processes have substantially delayed the deployment efforts of wireless providers, as well as carriers that support the provision of voice and broadband wireless services."

Ninth Circuit Consolidates Petitions for Review of Restoring Internet Freedom Order

On March 15, the Ninth Circuit Court issued an Order consolidating 15 petitions for review of the Restoring Internet Freedom Order.

The Court also issued a briefing schedule

May 29, 2018 - Petitioners' and petitioner-intervenors to file their consolidated opening brief
June 28, 2018 - Respondents to file their consolidated answering brief

Petitioners' and petitioner-intervenors must file their consolidated optional reply brief 28 days after service of respondents' brief.

FCC Releases Agenda for
March 22 Open Meeting

Last week, the FCC issued the agenda for its March 22, 2018 Open Meeting. The FCC will consider:

Second Report and Order that would clarify and modify the procedures for NHPA and NEPA review of wireless infrastructure deployments
Second FNPRM to address the problem of unwanted calls to reassigned numbers
Notice of Inquiry examining location-based routing of wireless 911 calls to ensure calls are routed to the proper 911 call center;
Sixth FNPRM to stimulate use of and investment in the 4.9 GHz band
An NPRM proposing to streamline the reauthorization process for TV satellite stations that are assigned or transferred in combination with a previously approved parent station;
Second Report and Order and Second FNPRM that would remove the personal use restriction for provider-specific consumer signal boosters and seeks comment on ways to further expand access to consumer signal boosters.

The meeting is scheduled to start at 9:30 a.m. at FCC headquarters in Washington, D.C. and can be viewed live online at www.fcc.gov/live.

House Passes RAY BAUM Act

Last week, the House passed the RAY BAUM Act (H.R. 4986), a package of telecommunications bills that establishes new funding for the repack of broadcast stations (following the incentive auction), and includes the FCC reauthorization and process reforms. It also includes the MOBILE NOW Act, the Spectrum Deposits Act, the RESPONSE Act, and "Dig Once" legislation.

Leaders in both chambers are also attempting to incorporate the legislation into the omnibus spending bill that Congress must pass by Friday, March 23.
