First step in new tool for securing services for your clients
The first successful step in an important legislative change happened this afternoon in the NJ Senate Commerce Committee from a joint effort of the NJ Society for Clinical Social Work and NASW-NJ. But ultimate success means following the first step with many more. And that means you must Stand Up as Social Workers to achieve that ultimate success.
We have heard concerns from many of you over the years that you have been forced to make a choice between your ethical responsibility to secure appropriate behavioral health services for your clients, and your legal responsibility under the Social Work licensing Regulations of the Board of Social Work Examiners (BSWE). The Regulations limit the amount and type of information you can provide to insurance companies, but often they reject claims, delay approvals, or refuse payment based on their demands for information beyond what is needed to give approval.
We have been meeting with Senator Gordon (D-38-Bergen) on a number of behavioral health issues. Today his bill, S2805, was passed out of committee unanimously, to be sent for a floor vote in the Senate. The health insurance companies, which are regulated by the Department of Banking and Insurance (DOBI) can currently ignore the rules of the BSWE. When the law passes, insurance companies will be held accountable by law to the same regulations you follow from the BSWE, when requesting information and granting approval.
But remember - this is only a first step. We will be seeking more examples of this problem, asking for some of you to testify, asking all of you to contact your legislators to insist on action in moving this legislation forward.
And in the coming weeks behavioral health parity legislation that we have been working on with a number of advocacy partners, will be posted for action. This could happen as soon as next Thursday (June 8), and we need you to Stand Up!

Then be ready to act immediately when the alerts go out. We can only be successful when we work in concert with each other as Social Workers are trained to do.
