TCAA MINUTE
May 19, 2017 TCAA Capitol Activities Only about one week remains until the Texas Legislature adjourns "sine die" (Latin for "without a day") in the 2017 Regular Legislative Session, and TCAA continues tracking and analyzing bills even as the clock winds down. While problematic bills and amendments are not officially dead until the final gavel of the legislative session, it is worth taking a moment to commend the TCAA legislative team for their efforts during the last several months. The hard work of the TCAA advocacy team at the capitol and the TCAA Board's legislative review team behind the scenes, as well as everyone who attended the TCAA Capitol Rally Day, helped ensure that community associations across Texas can continue to operate in a manner that protects and supports homeowners and community associations. Special Session This Summer?
The biggest news from the last week was Lieutenant Governor Dan Patrick's press conference last Wednesday to announce that he intends to force a special legislative session if the House does not pass several of Patrick's pending legislative priorities, including SB 2 (property tax reform) and SB 6 (transgender bathroom bill). It is unclear exactly how this latest development will impact the remaining days of the legislative session. Governor Greg Abbott issued a statement affirming that property tax reform and bathroom privacy are priorities that must be passed, but expressed confidence that the work can be completed during the remaining days of the regular session. House Speaker Joe Straus responded by naming several House priorities that have not been advanced by the Senate, and stating that he hopes Lieutenant Governor Patrick will reconsider his position. Bills of Note Below is an overview of the most high profile bills affecting community associations. Most of these bills will not pass before the end of the legislative session:
- HB 561, relating to the operation of golf carts and utility vehicles, was heard by the Senate Transportation Committee on May 10 and recommended for the Senate Local & Uncontested Calendar
- SB 1609, relating to regulation of religious displays and the Senate companion to HB 522, was passed by the Senate, and reflects some of the changes advocated by TCAA, however the bill has not been heard by the full House
- HB 522, relating to regulation of religious displays, failed to get placed on the last House floor calendar, and is therefore dead
- HB 923, relating to excessive property owners' association fines, failed to get placed on the last House floor calendar, and is therefore dead
- HB 1572, relating to the removal of trees believed to be a fire risk, failed to get placed on the last House floor calendar, and is therefore dead
- HB 2320, restricting declarant control of property owners' associations, failed to get placed on the last House floor calendar, and is therefore dead
- HB 3065, relating to mechanic's, contractor's, or materialman's liens on condominiums, failed to get placed on the last House floor calendar, and is therefore dead
- HB 3528, relating to the collection of past due assessments by a property owners' association, failed to pass out of House committee and be placed on the last House floor calendar, and is therefore dead
- SB 2234, relating to the collection of past due assessments by a property owners' association and the Senate companion to HB 3528, has not passed out of Senate committee and, and is likely dead
Upcoming Legislative Deadlines In the final week of session, almost every day presents another procedural deadline. Upcoming deadlines include:
- Friday, May 19: Last day for House to consider local House bills
- Saturday, May 20: Last day for House committees to report Senate bills and Senate joint resolutions
- Sunday, May 21: 10pm deadline for House to distribute its last House Daily Calendar with Senate bills and Senate joint resolutions
- Tuesday, May 23: Last day for House to consider Senate bills on Regular Calendar
- Wednesday, May 24: Last day for Senate to consider all bills
- Monday, May 29: Last day of session; technical corrections only
Sunday, June 18
: Last day for Governor to veto bills passed during last 10 days of the session

The PCAM Case Study is a comprehensive examination of an actual community association, combining classroom discussion with an extensive on-site inspection. You'll explore the community in depth, reviewing its administrative procedures, legal documents and communications; meeting with its manager, board members and key personnel; and learning about the local area. You'll be encouraged to ask questions and openly discuss issues faced by the association.
