TCAA Capitol Activities
As the Texas Legislature heads into the final three weeks of the legislative session, the TCAA team remains busy tracking and analyzing bills impacting community associations. The week of May 8-12 will be the last time for House bills to pass out of the House, and the House members will be on the floor debating bills until near midnight each night that week. For updates on TCAA activities and events, please visit the TCAA website: www.txcommunityassociationadvocates.org Delays in House and Senate Meanwhile, the House and Senate continue an apparent standoff, where each chamber is holding the other chamber's bills instead of referring them to committee and passing them to the floor. Through the end of April, nearly 80 percent of the almost 600 bills and joint resolutions that have cleared the Senate had not yet been assigned to committees in the House. On the Senate side, around 45 percent of the nearly 400 measures passed by the House had not been referred to Senate committees. While such gamesmanship is typical at the capitol during the late stages of the session, the volume of bills being delayed is larger than usual. Bills of Note HB 1572 by Rep. Workman was passed by the House Business & Industry Committee on May 3rd. The bill as filed prohibited enforcement of any restrictions that would prevent a landowner from removing a tree on the owner's property that the owner "believes" to be a fire risk. There were some exceptions included in the bill, but TCAA still had concerns about the lack of an objective standard for assessing risk and about application of the provisions in a condominium setting. Rep. Workman offered a committee substitute for HB 1572, and TCAA is analyzing the new language. Time is running out for this bill to make it to the House floor. HB 3528 by Rep. Vo and SB 2238 by Sen. Menendez each seem to have stalled out in committee, though TCAA will continue to monitor these troublesome bills to ensure they are not moved at the last minute or amended onto other legislation. These complicated and vague bills impose limitations on interest, late fees, collection costs, methods of payment, and attorney's fees. While TCAA supports fair and reasonable fees for collections, these bills substantially erode the ability of property owners' associations to hold an owner accountable for the assessment obligation that funds the services and amenities of a community. The looming May 8th and May 11th deadlines for passage of House bills by the House means that the following bills, none of which have Senate companions that are advancing, are also close to death:
- HB 522, relating to regulation of religious displays
- HB 923, relating to property owners' association fines
- HB 2320, restricting declarant control of property owners' associations

The PCAM Case Study is a comprehensive examination of an actual community association, combining classroom discussion with an extensive on-site inspection.
