Tree Myths: My house, my tree?
Information brought to you by the Arbor Day Foundation

In the next couple of months, we will be sharing with you the Top 10 tree myths about community forestry by the Arbor Day Foundation. The purpose of this is to help you learn about your legal rights and limitations regarding the trees in the city and on/near your property.

Myth 1: If it's by my house, It's my tree

According to the Arbor Day Foundation, this rule can vary from city to city depending on how the cities ordinances are written. In most cases, any trees, regardless of who planted it, if the tree is on the street easement, it belongs to the city.
  • Which trees or planting spaces to inventory.
  • Who should prune and care for trees.
  • Who is likely to be liable if lack of care causes an accident.
  • How the malpractice of topping can legally be stopped.
  • How the removal of trees can be controlled.
  • Who pays for the tree work or removal.
It is essential to know any legal information about performing work on an existing tree, planting new trees or removing one in your city.

To find out more information about the new Tree Preservation Ordinance in South San Francisco, please contact the Parks Division  (650) 829-3837. You can also visit us online to download the tree removal permit.
