NEW LEGAL FUND BEING TALKED ABOUT TO TO FIGHT THE REPACKING AND CLEARING OF LPTV AND TRANSLATORS FROM THE $16 BILLION OF SPECTRUM THE GOVERNMENT SOLD

BRING ON THE LEGAL CASES!

"For 5 years we have kept our powder dry, and have not been in the courts.  We knew we could not win those cases, and did not even try.  But the repack is different.  The auction winning bidders need to hear loud and clear that LPTV will NOT be moving when they want to start testing in a PEA, but when we are ready.  We will be offering engineering services to counter any of the claims of testing in a PEA, and those companies had better have engineering proof they need us to shut down.  If tower crews and equipment are not available, then too bad, we all will have to wait. And we are also putting NAB on notice that if it goes back to Congress for more money and does not include LPTV and translators, well, this is also what legal funds are raised for.  

Frak the FCC, frak Congress, frak the primaries, frak the regulatory class, and frak the winning bidders.  None of them has helped us at all.  So if we can now slow down, even a week here, a month there, a court case 6 months over there, then we will be winning, and making them all suffer monetary damages, as they have and are creating for us.  For 5 years they have laughed at us and said we were secondary and to shut up. And now it is time for payback.  All of these groups have conspired to work against our family legacy businesses, our  livelihoods, and our viewers.  So whatever we can do to screw with their repacking and deployment plans, good, let's do it. It's time to start making the rigged broadcast system they are all part of pay for what they are doing to us. And it is time to make those members of Congress who do not support us suffer in the midterms. Our viewers are not secondary!

EDITOR'S CORRECTION


COALITION ANNOUNCEMENT
Last week we reported the Advanced Television Broadcasting Alliance had reported in their newsletter above, that they were in attendance when the Coalition had its big meeting with Chairman Pai.

This was incorrect, and we were trying to be nice and not call them out about lying in their newsletter about it.  Here is the truth.  ATBA was never invited to the meeting, simply because they are really just part of SInclair and do not really rep general LPTV interests.  And they do not really do anything here at all.  While two of their Board members were in the meeting as company owners and rep's, never once in the meetings, nor in the materials, was ATBA ever even mentioned.  ATBA had no input into the meetings, nor any input into the Coalition asks.  And for them to say otherwise is a bold face lie which they need to apologize to the industry about.  ATBA does not list their members, and have made numerous annual financial filings without disclosing who their members are and where they get their funding.  We do know that they get almost all of their funding from Sinclair broadcasting.  So why is Sinclair funding a front group like this?  Well back 5 years ago, when ATSC 3.0 was not even being discussed, Sinclair wanted a way to promote to go flex.  So ABTA was formed to help with that, and LPTV was considered ripe for picking off cheap. But then our Coalition was formed, completely in the sunshine, the auction got slowed down, and 3.0 was completed, and the rest is history.  So, if you hear from ATBA that they were in the meeting with the Chairman, FAKE NEWS!

So you have read this far and must be wondering, "Mike, are you serious, suing to stop the repack?" Yes, for sure, this is a great tactic, and you can bet the winning bidders comm counsel are all emailing right now about it.  This is and has always been the weak spot in the auction, the repack.  And this is where we can get that relo funding we need, and to get concessions on other vital issues we need addressed like Class A and flex.  

A week here and there, a month over there, and the winning bidders are going to go nuts. And what can they do?  Go to the FCC, go to court?  Yes, and they will.  But there is no way to clear the PEA unless you agree to stop broadcasting.  And if it they get done before 39 months, well, that will bring it back into court.  And that will take months, months, months.....none of this repack crap has yet to be litigated.
