Employer's Rounding of Time Worked Policy Ruled Okay: What Have We Learned?

Defendant Home Depot moved for partial summary judgment on the plaintiff John Utne's claims related to Home Depot's rounding policy. In this case, Home Depot (employer) filed a motion for partial summary judgment based on plaintiff John Utne's (employee or Utne) claims related to the company's rounding policy. Home Depot argued that its rounding policy was neutral on its face and in its application, and that it did not result in the systematic under compensation of hourly California employees. The court agreed and granted the motion for judgment as a matter of law on the employee's California Labor Code and Private Attorney General Action (PAGA) claims that were predicated on the rounding policy.

ANNUAL LAW UPDATE HELD IN SACRAMENTO
|
On Thursday, December 7, 2017, WCA members gathered at the Hyatt
 Regency in Sacramento for a presentation from labor law attorney, Gary Bethel. Mr. Bethel discussed the new legislative changes and significant case laws that affect labor and employment matters for car wash owners and operators in 2018. In addition, Assemblymember Jim Cooper stopped by before the presentation to speak with the attendees and answer their questions about the labor laws in California. The informative presentation and question and answer session helped to ensure that the attendees are up-to-date on all of California's labor laws by the new year.
