House Votes to Overturn 'Blacklisting' Executive Order on Federal Contractors
In action backed by the Business Roundtable, the House of Representatives last week voted 236-187 in favor of a Congressional Review Act resolution overturning regulations to enact a 2014 Executive Order (EO13673). Commonly known as the "blacklisting" regulations, the Department of Labor rules expanded reporting requirements for federal contractors that may have violated labor laws. "We strongly support the goals of ensuring that only responsible companies do business with the federal government and that those companies compete on a level playing field," wrote Wes Bush of Northrop Grumman, Chair of BRT's Education and Workforce Committee, to House members. However, he wrote, the executive order is unnecessary and redundant, would add $474 million in regulatory costs, and will increase litigation while pressuring employers to settle meritless claims. Court Lets Employers Retain Flexibility in Wellness Programs; BRT Had Filed Amicus Brief
The Seventh Circuit Court of Appeals has rejected an attempt by the Equal Employment Opportunity Commission (EEOC) to restrict incentives under employer-offered wellness programs. On January 25, the court dismissed EEOC v. Flambeau, an appeal from federal district court in which the EEOC has sued Flambeau because its company wellness program required employee health assessments and screenings that the commission considered coercive and a violation of the Americans with Disabilities Act. While a victory for employers, the court's action does not set a precedent; it dismissed the case as moot since Flambeau dropped its wellness programs. BRT sent a letter to the EEOC when it first sued three companies, including Honeywell, and followed with an amicus brief in support of Flambeau. BRT Draws on White House Meetings to Reaffirm Policies on Trade, Dodd-Frank Reform, Tax
President Trump's meetings with Congressional leaders and top CEOs last week - including eight BRT members - provided Business Roundtable an opportunity to reinforce its policies on trade and financial regulation. The White House meeting Thursday dealt with renegotiating the North American Free Trade Agreement (NAFTA). In social media and in outreach to reporters, BRT pointed to a recent statement: "NAFTA has helped create important markets for American-produced goods and services, but it is more than 20 years old and it makes sense to reexamine it." BRT highlighted its support for "smart financial regulation - including improvements to Dodd-Frank - that encourage greater investment and advance America's competitiveness in the global economy." BRT also noted a related interview with Mark Weinberger of EY, Chair of BRT's Tax and Fiscal Policy Committee, on tax reform.
The Top Line - The economy added 227,000 jobs in January while the unemployment rate remained steady at 4.8 percent, the Bureau of Labor Statistics reported last week. The strong payroll growth exceeded expectations, but the pace of wage growth disappointed.
