iLaw 2017: the ILS Global Forum on International Law

The ILAT,  which for over a decade has  been Miami's leading international law conference, is now "iLaw2017: The ILS Global Forum on International Law" .
 
iLaw will feature a rich program with interesting presentations on cutting-edge issues in international law. This year, iLaw2017 is joining forces with the International Centre of Dispute Resolution and featuring the new ICDR arbitration track. 



The Annual Florida Bar International Law Section Vis Pre-Moot Competition

The event will be held on Saturday, February 18, 2017 at JAMS Resolution Center in Miami (the day after the International Law Section's 2017 iLaw Conference).  The ILS Vis Pre-Moot prepares law students from the largest law schools in Florida and beyond for the Willem C. Vis International Commercial Arbitration Moot in Vienna. The daylong event includes four rounds between the competing law schools with South Florida practitioners serving as arbitrators.  The Florida Bar has approved CLE credits for this event.
 
We still need volunteer arbitrators for both the morning and afternoon rounds, which are scheduled as follows:  
 
AM ROUNDS from 8:30 AM to 11:00 AM
Round 1 - 9:00 AM
Round 2 - 10:45 AM
 
PM ROUNDS from 1:00 PM to 3:30 PM
Round 3 - 1:30 PM
Round 4 - 3:15 PM
 
After the competition has ended, Hogan Lovells will be hosting an awards ceremony cocktail at their offices, to start approximately at 5:30 PM. This is a great opportunity to help law students with their arguments before their trip to Vienna, as well as a great networking opportunity. If you are interested in serving as a volunteer arbitrator or would like more information, please email Cristina Vicens ([email protected] ) or any of the Committee Members, and indicate whether you prefer morning or afternoon rounds.

February 7, 2017
The sixth annual U.S. export controls year-in-review event, organized by the ABA, will discuss significant developments in 2016 with respect to U.S. export controls targeting Cuba and Russia as well as ongoing Export Control Reforms. After a busy 2016, this event will be helpful to, among others, compliance personnel updating and reviewing policies and procedures to make sure they reflect current U.S. export controls. We will also discuss enforcement trends under US export controls. The event will be held at  Baker & McKenzie  815 Connecticut Avenue, NW  Washington, DC 20006. The iLaw2017, the ILS Global Forum on International Law, newly rebranded from the former "ILAT", will be held on February 17, 2017 at the Conrad Hotel in Miami. The iLaw2017 will include the International Center for Dispute Resolution's (ICDR) Arbitration Track. The Program Brochure will be out shortly, but in the meantime, Save the Date!

February 21-25, 2017
Arbitration Rules in Practice, jointly organized by VIAC, YAAP, ArbAut and the Sommerhochschule. The course addresses young arbitration practitioners and PhD and diploma students and offers a four-day program on international commercial arbitration and participation in the Vienna Arbitration Days 2017. Vienna Arbitration Days 2017 The 10th Anniversary of VAD will discuss the topic "Repositioning Arbitration." March 2, 2017
A seminar titled Recognition and Enforcement of Arbitral Awards in Domestic Courts, hosted by Freshfields Bruckhaus Deringer, 601 Lexington Avenue, 31st floor, New York 10022 from 5 to 8pm. Domestic courts in the US and Europe have issued several recent decisions dealing with the enforceability of international arbitral decisions. From enforcing vacated awards, to the treatment of ICSID final awards, to arbitrator independence and sovereign immunity, these cases have affected the landscape for enforcement of international arbitration awards. On March 27, 2016, starting at 6pm at the Atlanta Campus of the University of Georgia School of Law, Terry Third Thursday Room, 3475 Lenox Road NE, Suite 300, Atlanta, Georgia 30326, Professor Gabrielle Kaufmann-Kohler of Geneva University Law School will deliver the Second Annual  Hendrix Lecture of the Atlanta International Arbitration Society (AtlAS) Professor Kaufmann-Kohler  is known worldwide for her expertise in international arbitration: she has acted in over 200 international arbitrations, mainly as an arbitrator. The lecture is presented by the Atlanta International Arbitration Society, the Dean Rusk International Law Center, and the University of Georgia School of Law, as part of the law school's Georgia Women in Law Lead (Georgia WILL) initiative. Rolls-Royce to pay $800 million for FCPA and other corruption violations

Last week, the U.S. Department of Justice (DOJ) announced that Rolls-Royce plc, a manufacturer and distributor of power systems in the aerospace, defense, marine and energy sectors, agreed to pay the U.S. $170 Million as part of an $800 million global resolution for violations of the U.S. Foreign Corrupt Practices Act (FCPA) and other anti-corruption laws investigated by the U.K. and Brazil.
 
 According to the DOJ, Rolls-Royce violated the anti-bribery provision of the FCPA by paying more than $35 million in bribes through third parties to government officials in 12 countries to secure government contracts.  For example, in Thailand, the company paid approximately $11 million in bribes to government officials at state-controlled oil and gas companies in exchange for seven contracts.  In Brazil, Rolls-Royce paid over $9 million in bribes to officials at Petrobas, the Brazilian state-owned oil company, in exchange for multiple contracts. In Kazakhstan, the company paid over $5 million in commissions to advisors knowing that a portion of it would be used to bribe officials with influence over a state-owned joint venture that awarded the company multiple contracts.  Other countries affected by the Rolls-Royce bribery scheme included Angola, Azerbaijan, China, India, Indonesia, Iraq, and Russia.
 
"This successful parallel investigation is a tremendous example of the central importance of working cooperatively alongside our international partners to achieve a fair and meaningful resolution," said FBI's Criminal Investigative Division, Assistant Director in Charge Paul M. Abbate.
 
This case demonstrates the continued multinational investigation and enforcement collaboration among U.S. and foreign government agencies against bribery. It also reflects the importance for companies conducting business internationally to conduct adequate due diligence and implement effective controls to ensure that advisors, agents and other third parties are not used as intermediaries to bribe government officials.
 
With record-setting fines being levied in the billions of dollars, coupled with the DOJ and SEC's increased resources and aggressive multinational enforcement, it is more critical than ever for companies to establish and assess Anti-Corruption Compliance Programs.
