Forklift Operating Training Requirements

Looking at all citations over the 4-year period of 2012-2016, the LBM sector was cited most for violation of provisions of Standard 1910.178 (Powered Industrial Trucks). Specifically, the sector has been cited for the following violations relating to operator training:
  1. Employers must ensure that each operator is competent to operate the forklift as demonstrated by completion of training and evaluation requirements.
  2. Trainees may only operate a forklift under the direct supervision of persons who have the training and experience to train and evaluate trainee competence. 
  3. Training must consist of a combination of formal instruction and practical training and evaluation of the trainee's performance.
  4. Instruction may be provided through lecture, interactive computer learning, video tape, or written material. The practical training must include demonstrations by the trainer and exercises performed by the trainee.
  5. LBM dealers have been cited for not training on: 1) operating instructions, warnings, and precautions for the types of forklift the operator will be authorized to operate; 2) vehicle capacity; 3) vehicle inspection and maintenance required by the operator; and 4) operating limitations. The sector has also been cited for not training adequately on ramps and other slopes.
  6. Refresher training and evaluation of the effectiveness of that training must be conducted to ensure that the operator has the prerequisite knowledge and skills needed to operate the forklift safely.
  7. Refresher training in relevant topics is required when an operator has operated the forklift in an unsafe manner or when the operator has been in an accident or near-miss.
  8. Certification must include the operator's name, date of training, date of the evaluation and the identity of the person(s) performing the training.

OSHA Sued Over New Injury Reporting Rule

The National Association of Home Builders (NAHB), the U.S. Chamber of Commerce and other groups have filed suit against the U.S. Occupational Safety and Health Administration (OSHA) in the U.S. District Court for the Western District of Oklahoma over its new rule that requires companies to make all of their injury and illness data public. The lawsuit contends that the rule is "arbitrary, capricious, and otherwise contrary to law" and that it violates the first and fifth amendments of the Constitution. 

T he new rule requires employers in high-hazard industries, such as manufacturing and construction, to send injury and illness data directly to OSHA, which would then post it on the agency's website. "Among the many issues with the rule, there are significant concerns associated with OSHA's requirement of employers to submit detailed injury and illness logs to the agency for public posting. Not only does OSHA not have the authority to do this, it also exposes a business to significant reputational harm, all without demonstrating any evidence that it would effectively reduce workplace injuries and illnesses," says NAHB Chairman Ed Brady.
