This Monday, January 16, all courts, Federal and Superior, will be closed observing Martin Luther King Jr. Day.

 

DDS Legal will be open.

 

Any work picked up Monday will be presented to courts Tuesday or beyond.

UNLAWFUL DETAINER - EX PARTE CHANGES
  
Ex parte applications for unlawful detainer cases at the Stanley Mosk Courthouse should be noticed for 1:30 p.m. in Department 94.

Ex parte applications with fee waivers are processed on the first floor in Room 106.

All ex parte applications for unlawful detainer cases at the Stanley Mosk Courthouse must be filed by 11:00 a.m. in Room 102 (Superior Court of Los Angeles County, Local Rules, rule 3.5(a)(3)).
 
Ex parte applications for unlawful detainer cases at the Stanley Mosk Courthouse shall have a separate application, a separate declaration of ex parte notice, and a separate proposed order.
 
A bsent good cause, notice must be given by 10:00 a.m. the day before the hearing as required by California Rules of Court, rule 3.1204.

EXPEDITED UNLAWFUL DETAINER PROCEEDINGS
  
In an effort to streamline and expedite unlawful detainer proceedings, the following court orders have been made:

Finding of Fact in Unlawful Detainer Proceedings -

If a party does not stipulate to the hearing of any unlawful detainer matter assigned to a commissioner, said commissioner is directed to hear the motion or trial as a referee, pursuant to Code of Civil Procedure section 639.

Showing Good Cause to Shorten the Time to Hear Demurrers in Unlawful Detainer Cases -

When a party files a demurrer to an unlawful detainer case in any court of this County, and the filing party requests a hearing date more than 10 calendar days from the date of filing, the court may determine there is good case to hold the hearing on an earlier or later date pursuant to California Rule of Court, rule 3.1320(d).

Authority for the Clerk's Office to Process Status Conference Hearings -

The clerk's offices handling unlawful detainer matters will process the status conference hearings. Upon written or verbal request of the plaintiff or plaintiff's attorney, for no more than two requests, the clerk's office may continue the status conference hearing for thirty (30) days from the current hearing date. Any subsequent request for continuation will be reviewed by a judicial officer. If there is no request for continuance and no subsequent filings beyond the summons and complaint, the clerk's office may dismiss the unlawful detainer complaint.
