Off-Duty Conduct: Permissible Responses in the Worlds of Public and Private-Sector Employment
More than ever, employers are pressured to respond to illegal or “offensive” off-duty conduct of their employees when the employer or the public disagrees with the protester’s message. But, an employer’s appropriate (and legally defensible!) response to off-duty conduct depends on a number of factors. Join us as we walk through real case studies and discuss the factors that public and private sector employers need to consider when responding to off-duty conduct:
- First amendment rights of public and private sector employees
- Higher standards for conduct of public employees
- Discipline based on arrest and conviction records
- Standards for imposing discipline for at-will versus contractual employees
Our program will begin with breakfast and networking from 7:30 - 8:00 a.m., followed by a presentation from Buelow Vetter attorneys Mark Olson, Kevin Pollard and Claire Hartley.
